Samsung Galaxy Watch bands class action lawsuit overview:
- Who: Plaintiff Anthony Ray Gonzalez filed a class action lawsuit against Samsung Electronics America Inc.
- Why: Gonzalez claims Samsung sells Galaxy Watch bands containing excessive levels of per- and polyfluoroalkyl substances (PFAS).
- Where: The class action lawsuit was filed in California federal court.
A new class action lawsuit alleges Samsung sold Galaxy Watch bands containing excessive levels of per- and polyfluoroalkyl substances (PFAS).
Plaintiff Anthony Ray Gonzalez’s class action lawsuit claims Samsung advertises the Galaxy Watch bands as being designed to support and further human health and wellness, without revealing the presence of the toxic PFAS.
“Consumers also reasonably rely on manufacturers to accurately and completely disclose significant and hidden dangers posed by products,” the Samsung Galaxy Watch bands class action says.
Gonzalez wants to represent a nationwide class and California subclass of consumers who bought a Samsung Galaxy Watch Fluoroelastomer Band, Sport Band (20mm), Sport T-Buckle Band, Rugged Sport Band, Extreme Sport T-Buckle Band and D-Buckle Hybrid Eco-Leather Band within the applicable statute of limitations period and the last four years, respectively.
Samsung purposely markets Galaxy Watches to health-conscious consumers, class action says
Gonzalez argues Samsung purposely implemented a “pervasive and widespread” marketing campaign to cater the Galaxy Watches to health-conscious consumers who “reasonably seek smartwatches that are safe for everyday use and to further their health overall.”
“Consumers thus purchase the Products with consideration toward, and reasonably expect quality, safety, and sustainability to further and protect their own health while minimizing environmental impact,” the Samsung Galaxy Watch bands class action says.
Gonzalez claims Samsung is guilty of fraud, fraudulent inducement, fraudulent concealment or omission, fraudulent misrepresentation, violating California consumer protection laws and more.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages for themselves and all class members.
A consumer filed a separate class action against Samsung in August 2024 over claims the company manufactured more than 1 million ranges with defective knobs that can be turned on accidentally, posing a potential fire hazard.
