Safeway inflates the regular price of grocery items offered under its โBuy One, Get One Freeโ promotion so that consumers pay โsubstantially more for the first product to cover the cost of the second,โ a new class action lawsuit alleges.ย
Plaintiff Kim Siflinger claims Safewayโs alleged conduct prevents customers in Washington from actually receiving a second item for free under the grocery storeโs BOGO promotion.ย
โInstead, they pay more for the product and buy more of the product than they otherwise would in order to obtain the illusory โfreeโ product,โ the Safeway class action states.ย
Siflinger argues Safeway is violating Washingtonโs Consumer Protection Act (CPA). She wants to represent a Washington class of Safeway shoppers who allegedly overpaid for items offered as part of the storeโs BOGO promotion within the past four years.ย
Safeway BOGO promotion has customers โpay for a seemingly free product,โ says class action
Common items offered in the Safeway BOGO promotions are boneless pork chops, chicken breasts and thighs, beef steaks, ice cream, coffee, and frozen seafood, according to the Safeway class action.ย
In addition to its โBuy One, Get One Freeโ promotion, Safeway also offers a โBuy One, Get Two Freeโ sale, however, Siflinger claims this also simply has customers โpay for a seemingly โfreeโ product.โย
โAs a direct and proximate result of Defendantsโ unfair acts or practices, Ms. Siflinger and the Class have suffered an injury in fact and lost money,โ the Safeway class action states.ย
Siflinger is demanding a jury trial and requesting injunctive and declaratory relief along with an award of actual and treble damages for herself and all class members.ย
A separate class action lawsuit was filed against Safeway and Acme Markets in June 2022 by a consumer arguing the Albertsonโs Companies stores misrepresented some of their Signature Care brand of over-the-counter acetaminophen drugs as being โrapid release.โย

I actually used to work for them. The issue I see is that safeway has its โactual priceโ posted all of the time. They take away the sale price of the item and offer a different sale. There are definitely other things they can be sued for by customers cause ๐คฎ

Several months ago Amazon sent me a notice that the Jif peanut butter I had purchased from them had been recalled. Jif recommended that customers throw away the recalled product and said they would reimbuse them. I sent Jif a copy of the receipt for the case of peanut butter I had purchased. All they did was send me coupons to deduct from the price of more purchases of Jif. Are they not required to reimburse the purchase price, especially after recommending that customers should dispose of the peanut butter and announcing that they would reimburse customers?
Itโs true in Arizona. They raise the prices and so does Kroger. Itโs wrong and complete BS but they have gotten away with it for years now. I never buy when they have a BOGO free special going on. Buyer beware of the BS! Wish they would do a lawsuit in AZ.

I remember when they started doing the buy one get one free and I was so excited to stretch my food budget. And I go to the store and the price per pound was exorbitant! Things that were 299 a pound on sale before weโre now 799 to 999 a pound most the time making it so it was more than the original price per pound when you didnโt get one free
Yes there are always issues with the new sales on Wednesdayโs not just Bogo items and individual items. You have to take pictures of shelf tags and self check your items in hopes of not being cheated.
Kroger/Frys does the same thing. They often have Buy one get TWO free. If say Foster Farms Chicken breasts are $3.05 lb. I would take this deal every time its available. Now the deal comes up and same chicken is as much as $7 โ $9 a lb. They can keep that deal.
Agree as well. I always have to check my recovers due to sales signs not removed after sale. Not getting correct discount form app
