Safeway promotions class action lawsuit overview:ย

Safeway inflates the regular price of grocery items offered under its โ€œBuy One, Get One Freeโ€ promotion so that consumers pay โ€œsubstantially more for the first product to cover the cost of the second,โ€ a new class action lawsuit alleges.ย 

Plaintiff Kim Siflinger claims Safewayโ€™s alleged conduct prevents customers in Washington from actually receiving a second item for free under the grocery storeโ€™s BOGO promotion.ย 

โ€œInstead, they pay more for the product and buy more of the product than they otherwise would in order to obtain the illusory โ€˜freeโ€™ product,โ€ the Safeway class action states.ย 

Siflinger argues Safeway is violating Washingtonโ€™s Consumer Protection Act (CPA). She wants to represent a Washington class of Safeway shoppers who allegedly overpaid for items offered as part of the storeโ€™s BOGO promotion within the past four years.ย 

Safeway BOGO promotion has customers โ€˜pay for a seemingly free product,โ€™ says class action

Common items offered in the Safeway BOGO promotions are boneless pork chops, chicken breasts and thighs, beef steaks, ice cream, coffee, and frozen seafood, according to the Safeway class action.ย 

In addition to its โ€œBuy One, Get One Freeโ€ promotion, Safeway also offers a โ€œBuy One, Get Two Freeโ€ sale, however, Siflinger claims this also simply has customers โ€œpay for a seemingly โ€˜freeโ€™ product.โ€ย 

โ€œAs a direct and proximate result of Defendantsโ€™ unfair acts or practices, Ms. Siflinger and the Class have suffered an injury in fact and lost money,โ€ the Safeway class action states.ย 

Siflinger is demanding a jury trial and requesting injunctive and declaratory relief along with an award of actual and treble damages for herself and all class members.ย 

A separate class action lawsuit was filed against Safeway and Acme Markets in June 2022 by a consumer arguing the Albertsonโ€™s Companies stores misrepresented some of their Signature Care brand of over-the-counter acetaminophen drugs as being โ€œrapid release.โ€ย

    Been shopping at Safeway and I have been noticing that it is true. They make the price of one product so high, in the end we are paying for both products instead of getting one โ€œfreeโ€

    I have been shopping at safeway for nearly 30 years and often purchase the BOGO deals. So unfair what we consumers have to put up with. Most of the time, I just want one item, but you have to purchase the required amount in order to get the deal.

    I have for years shopped with Safeway and Albertsonโ€™s. I never really thought about it that much until my family got so large, there is twelve of us. I have shopped mostly for the buy one or two and get one free but itโ€™s been just in the the last couple of when I realized that I was sometimes paying more and getting less. I bargin shop because of the size of my family and my husband and I live off of his Social Security and Veterans Disability pay. I have too make every penny count so for our family and a host of others this is very unfair.

    This is true. A practice done for many years. It is bait to get you to spend in an over priced store. Safeway has some of the highest prices around.
