Monsanto Roundup Glyphosate Lawsuit Overview: 

  • Who: A married couple filed a lawsuit against Monsanto Company. 
  • Why: The couple claims Monsanto was negligent in manufacturing and selling Roundup weedkiller containing glyphosate, a known human carcinogen.
  • Where: The lawsuit was filed in Georgia federal court.

Monsanto Company negligently manufactured, packaged, advertised, and sold Roundup weedkiller containing the carcinogenic herbicide glyphosate, a new lawsuit alleges. 

Plaintiffs Arthur J. King, Jr. and Veronique L. Horne-King claim Monsanto is wrong to sell a product containing glyphosate and has failed to warn consumers about Roundup’s dangers

King and Horne-King — a married couple — claim King developed non-Hodgkin’s lymphoma after being exposed to glyphosate and surfactant POEA in Roundup weedkiller

Monsanto, meanwhile, has been aware that glyphosate is carcinogenic since as far back as the early 1980s, the lawsuit alleges. 

Further, research from the Environmental Protection Agency (EPA) and other studies has shown that the glyphosate in Roundup is even more dangerous when combined with the weed killer’s other ingredients.

“Despite its knowledge that Roundup was considerably more dangerous than glyphosate alone, Defendant continued to promote Roundup as safe,” states the lawsuit. 

King and Horne-King claim Monsanto has also refused to perform appropriate safety tests on its product, choosing instead to rely on studies they say are designed to help maintain the economic best interests of its brand. 

Monsanto Knew Roundup Dangerous to Users, Claims Lawsuit

In 2015, the International Agency for Research on Cancer (IARC) concluded that glyphosate like that contained in Roundup is a “probable carcinogen” to humans and animals and can cause DNA and chromosomal damage to human cells,  according to the complaint.

“Despite the new classification by the IARC, (Monsanto) has had ample evidence of glyphosate and Roundup’s genotoxic properties for decades,” states the couple in their claim. 

King and Horne-King claim Monsanto is guilty of negligence, failure to warn, selling a product with a design defect, breaching implied warranties, and causing Horne-King to suffer loss of consortium. 

Plaintiffs are demanding a jury trial and requesting compensatory damages and all other relief the court deems proper. 

A similar class action lawsuit was filed against Monsanto last month by a Minnesota consumer who claims Roundup caused him to develop lymphoma

Also last month, a federal judge mostly declined to dismiss a securities class action lawsuit filed against Bayer — which acquired Monsanto back in 2018 — by investors who claim it failed to adequately take the risks of acquiring the company into account.

    I grew up working in fields while the plane would be using roundup a because I was short I was exposed to roundup
