A class action complaint, a recall and a settlement involving car seats or booster seats were recently in the headlines over claims of safety concerns.
Such allegations and recalls are not a new issue for consumers, with similar claims resulting in settlements in previous years.
Class action claims Nuna Rava convertible seats unsafe for kids
A group of consumers filed a class action lawsuit against Nuna Baby Essentials last month over claims the company sold defective car seats that are unsafe for children.
The class action lawsuit argues the company’s Nuna Rava line of convertible car seats — recalled by Nuna in December 2024 — have a defect that impedes the front harness adjuster button from properly clamping on the harness strap.
The consumers claim the defect causes the harness to not securely tighten or loosen, thus preventing the car seats from properly restraining the occupant and increasing the risk of injury in the event of a crash.
“This Defect renders the Products unsafe and unsuitable for their intended purpose, and increases the risk of injury in the event of a crash,” the Nuna class action says.
Aton car seats recalled over concerns harness straps can break
Columbus Trading-Partner issued a recall in February for several makes of its Aton car seats over concerns their harness straps can break, putting children at risk of injury.
The recall involves certain Cybex Aton G, Aton G SensorSafe, Aton G Swivel, Aton G Swivel SensorSafe, Eos and Aton G Swivel Travel System, and Eos and Aton G Travel System car seats.
The company said it is concerned the car seats’ harness hip anchorage retention hooks may bend, causing their anchor pin to loosen and the harness strap to detach. This could result in potential whiplash or other neck injuries.
“In the event of a vehicle crash, the detached harness would not properly restrain the occupant, increasing the occupant’s risk of injury,” the car seat recall says.
Evenflo agrees to pay $3.5M to end claims it overstated safety of ‘Big Kid’ booster seats
Evenflo agreed last month to pay $3.5 million to resolve claims the infant and juvenile product manufacturer overstated the safety of its “Big Kid” vehicle booster seats.
The class action settlement will benefit verified buyers of the Big Kid booster seats. All verified buyers will receive a $25 gift card, while those who can show they purchased two of the booster seats are set to receive $50.
A group of consumers argued Evenflo made misleading claims about the performance ability of the booster seats during side-impact collisions, especially when the occupant of the seat was a child under 40 pounds.
Several class action lawsuits were filed against Evenflo after media reports cast doubt over the company’s claims the booster seats had been safety tested for children weighing between 30 and 110 pounds.
Settlement approval to end claims Chicco Kidfit booster seats not as safe as advertised
A final approval hearing for a class action settlement involving Artsana was rescheduled for earlier this month.
Artsana agreed to a class action settlement in early 2023 to put an end to claims the company’s Chicco Kidfit booster seats were not as safe as advertised.
The class action settlement will benefit a class of consumers who purchased a Chicco KidFit-branded booster seat, including the KidFit, KidFit Zip, KidFit Zip Air, KidFit Luxe, KidFit Plus and KidFit Air Plus models, between April 22, 2015, and Dec. 31, 2021.
Artsana was accused of falsely advertising its booster seats by allegedly misrepresenting their minimum weight requirements and side impact collision protection.
The final approval hearing was previously scheduled for 2023 but was ultimately scrapped until this month due to sophisticated fraud attacks, as reported by media outlets.
Britax agreed, in 2020, to settle claims some models of Harness-2-Booster seats defective
Britax Child Safety Inc. agreed to a class action settlement in 2022 to end claims some models of its Harness-2-Booster car safety seat were defective.
The settlement benefited a class of California residents who bought a new Frontier ClickTight or Britax Pioneer Harness-2-Booster seat from Aug. 14, 2016, up to and including Aug. 14, 2020, for personal or household use.
The class action settlement was granted final approval in March 2023. Eligible class members were entitled to a refund of $40 for each class child seat they purchased, according to the class action settlement.
Orbit Baby infant and car seat settlement netted nearly $1 million for consumers in 2018
Orbit Baby Inc. and The ERGO Baby Carrier Inc. agreed to pay nearly $1 million in 2018 to put an end to claims the companies misrepresented that their infant and car seat products did not contain certain types of chemicals, such as brominated and chlorinated flame retardants.
The settlement benefited a California class of consumers who bought a new Orbit Baby infant or toddler seat between April 26, 2012 and Feb. 23, 2018 while living in the state.
The class action settlement was granted preliminary approval in Feb. 2018. Both Orbit Baby and The ERGO Baby Carrier denied any wrongdoing.
