Premiere Credit Faces Lawsuits Over Debt Collection Practices

Text Message LawsuitConsumers who have outstanding loans and those who have opted out from companies’ marketing programs both have protections from unwanted phone calls and text messages from these companies. Despite these rules, many debt collectors still contact consumers in violation of a federal law known as the Telephone Consumer Protection Act (TCPA). One of the companies accused of such violations is Premiere Credit of North America.

Premiere Credit is a debt collector that has been sued numerous times for violating the TCPA. The most common allegations raised in these lawsuits include that Premiere Credit called consumers using an automated dialing machine (a practice known as “robocalling”) and sent unsolicited text messages to consumers. 


Numerous lawsuits are pending against Premiere Credit of North America in federal court by consumers who have had enough and know their rights. 

There are a number of protections afforded by both the TCPA. Companies are not allowed to contact a consumer if they have opted out of receiving such phone calls or text messages. When a plaintiff who cites the TCPA specifically requests a company to stop sending text message spam or making unwanted phone calls to their cell phone, that request must be honored. 

Numerous TCPA lawsuits indicate that Premiere Credit of North America may not be following federal regulations. TCPA violations can result in damages of up to $1,500 per message in some cases.

    Feb.13, Brian Foley from Primiere Credit called me in regards to an outstanding loan. Foley claimed I could make a low payment based on hardship. I gave him my debit card info. Less than 24 hours later someone stole my info and purchased items at a mall in Troy Michigan, not that far from PC’s offices. I immediately suspected these slumbags. Called them today to find out if they collected their money from my card and without looking up my account number and only needing my zipcode they said oh, your card was rejected but you could just give us the number and we’ll try again. I asked for Brian’s supervisor. John gets on the phone and I ask him about the payments I authorized. He sas, oh maybe you didn’t have the money in the account. All of a sudden no one was concerned that the payment didn’t go through. I told John about the fraud on my card and he immediately blew up and started yelling. Why would someone get so defensive about something if they weren’t guilty. How is it that the same three people always answer the phone and despite being a company with thousands of employees, and presumably thousands of people owing money they didn’t even need my account number? These people are thieves. Filed a police report and will report them to authorities in Ind.
