If you’ve ever wondered if those trendy “Power Balance” bracelets worn by athletes and celebrities work, a new class action lawsuit has your answer: They don’t.
The Power Balance class action lawsuit alleges consumers have been duped into believing the hologram-embedded accessories are scientifically proven to enhance balance, flexibility and strength – even though there’s no proof to back up those claims. Even the head honchos of the company admitted they had “no credible scientific evidence that supported the representations,” yet they continued to “mislead” the public anyway, the class action lawsuit says, selling 3 million units in just three years.
Power Balance bracelets, wristbands, necklaces and pendants have one or more “Mylar Holograms” that the company claims react with your body’s natural energy flow and yield physiological benefits when worn close to your body. These false marketing claims, the class action says, include that “Power Balance holograms are embedded with frequencies that react positively with your body’s natural energy field to improve balance, strength and flexibility,” that the holograms “are designed to work with your body’s natural energy field,” that using the Power Balance accessories “results in lots of endurance and stamina,” and that the accessories “boost the body’s self defense mechanisms creating the immediate benefits of strength, balance and flexibility gain.”
In December 2010, in response to investigations by the Australian government, Power Balance issued a corrective advertisement stating, “We admit that there is no credible scientific evidence that supports our claims.”
Despite these admissions, the Power Balance class action says, the company continues to mislead the American public into purchasing their products.
The Power Balance class action lawsuit is brought on behalf of anyone who purchased Power Balance accessories (including Power Balance bracelets, wristbands, necklaces and pendants) not for resale in the United States within the last four years. It is seeking restitution and other relief to class members for unfair business practices and false advertising.
