Policy Holder Claims Unum Wrongfully Denied Claim for Disability BenefitsUnum Life Insurance Company of America faces a number of lawsuits over their disability coverage. Most recently, a policy-holder has filed a lawsuit claiming that Unum wrongfully denied her claim for disability benefits.

Plaintiff Teresa T. claims that she was an employee of the Stefanis Group, working as a Worker’s Compensation Insurance Coordinator/Billing Specialist. She states that during her time with the company, the Stefanis Group provided long-term disability insurance to its employees through Unum Life Insurance. She claims that she was improperly denied coverage from Unum after becoming disabled and filing a claim.

Teresa claims that she became disabled on or around Sept. 23, 2016, and in a timely manner, filed a claim with Unum to collect disability insurance benefits from the company. She claims that under the plan with Unum that she had via her employment with the Stefanis Group, she should have received benefits of at least 180 days of disability insurance.

According to Teresa, she required disability insurance because she suffered medical impairments including but not limited to “significant neck and back impairments requiring both cervical and lumbar surgeries; hyperlipidemia; hypertension; peripheral vascular disease; insomnia; ulcers; systemic disorder. She claims that these impairments qualify her as “disabled” under the terms of the Unum long-term disability insurance plan that the Stefanis Group provided to its employees.

Teresa states that Unum initially accepted her claim for disability insurance, and paid her benefits through Aug. 4, 2017, at which point Unum terminated her benefits. Allegedly, the company stated that her medical information no longer qualified has as “disabled” under the Stefanis Group’s plan, though she claims that her condition remained substantially the same, and that she was still disabled.

Teresa claims that she then appealed Unum’s decision to withdraw her disability insurance, again filing her claim in a timely manner. She states that in addition to filing her claim, she provided medical information to support her claim, including “updated medical records, treating physicians’ opinions and a Functional Capacity Evaluation (FCE).” She claims that Unum wrongly ignored this additional information and still denied her claim for a continuation of disability benefits.

Teresa claims that Unum wrongly denied her request for disability benefits to continue, arguing that the company’s decision was “arbitrary and capricious,” and willfully ignored medical evidence that she was still disabled and still qualified for disability insurance under her company’s plan. She seeks for Unum to pay her benefits that were unpaid to date, and to pay her disability insurance benefits going forward.
