SolarCity-TCPA-SettlementMembers who filed a proposed class action against SolarCity over claims of unwanted sales calls are currently seeking a $15 million SolarCity TCPA settlement.

In the lawsuit, the plaintiffs allege that SolarCity, which provides solar power systems for residential and business buildings, sent unwanted sales calls to consumers across the country in violation of the Telephone Consumer Protect Act, or TCPA. The plaintiffs asked a California federal court to grant preliminary approval of a $15 million SolarCity TCPA settlement, effectively ending the lawsuit.

According to the motion filed by the plaintiffs, “The proposed settlement is fair and reasonable and falls within the range of approval … It is the product of extensive arms-length negotiations between experienced attorneys familiar with the legal and factual issues of this case, including an in-person settlement conference.”

This motion comes after a long period of negotiation. The lawsuit was filed in 2015, and the plaintiffs have attempted to reach a SolarCity TCPA settlement much earlier. Back in May, the plaintiffs claimed they had a SolarCity TCPA settlement in the works, but SolarCity noted that details had yet to be worked out, while the basic outline was in place. Now, having “reached agreement as to all issues raised in the motion,” the SolarCity TCPA settlement has been brought to court for preliminary approval.

The plaintiffs submitted their request for approval on the $15 million SolarCity TCPA settlement on Wednesday, July 19. The SolarCity TCPA settlement means that no liability was ever determined in regards to SolarCity’s unwanted sales calls, and the matter was instead settled out of court. The settlement money will be split between the plaintiffs, and some will also go to legal fees.

TCPA Basics

The Telephone Consumer Protection Act, more commonly known as the TCPA, was first introduced back in 1991. The TCPA was intended to protect consumers from unwanted solicitation through technology.

The Telephone Consumer Protection Act has always focused on the placement of unwanted phone calls, or the use of an autodialer or pre-recorded messaging system to contact consumers who have not given their explicit permission to receive such calls. However, as new technology such as cell phones has emerged, the TCPA has further expanded to include text messaging as well as traditional phone calls.

Reporting TCPA Violations

According to the Federal Communications Commission, or FCC, reports of TCPA violations are extremely common—indeed, the FCC received more than 215,000 individual TCPA complaints in 2014 alone. Reporting TCPA violations may reward consumers with a set amount of award money per individual violation.

If you have received unwanted phone calls or texts from a company without having given prior express permission, or after placing your name on a federal Do Not Call list, you should be able to report these violations and receive compensation per violation.
