Filling Time Sheet with hoursA plaintiff, Adam E., files a lawsuit in Pennsylvania federal court alleging his former employer, Build-A-Bear Workshop, Inc., of violations of federal and state wage laws, or laws pertaining to the FLSA.

The FLSA, also known as the Fair Labor Standards Act, establishes a minimum wage, overtime pay, recordkeeping, and youth employment standards which affects employees both within private and federal sectors and the local government.

According to the overtime class action lawsuit, Adam, a resident of Easton, Penn., was employed by Build-A-Bear between November 2015 and approximately September 2016.

The overtime class action lawsuit contends that the plaintiff was required to do a training program where he was to learn all “aspects of the store operations, including reviewing and completing training modules.”

The overtime class action lawsuit asserts, however, that while he was then assigned to a Build-A-Bear store location, and had concluded the training, he had regularly worked more than 40 hours per week.

Adam’s overtime lawsuit maintains the “defendant was aware that plaintiff and the members of the FLSA Training Collective and the FLSA Collective worked more than 40 hours per workweek, yet defendant failed to pay them overtime compensation for any of the hours worked over 40 in a workweek.”

Instead, according to the overtime class action lawsuit, Build-A-Bear had paid Adam and the other proposed Class Members weekly salaries, but no overtime compensation was included.

The lawsuit further maintains that the defendant never recorded the hours that the plaintiff worked, nor for other members of the proposed Classes.

Adam is currently alleging violations of the Fair Labor Standards Act due to unpaid overtime wages. This overtime class action lawsuit further includes all members and is served on behalf of the plaintiff and the proposed Classes.

Build-A-Bear is a Delaware corporation, headquartered in St. Louis, Mo. They operate in retail stores throughout the U.S. which includes selling teddy bears and other stuffed animals.

According to the overtime class action lawsuit, and the most recent 10-K filed with the Securities and Exchange Commission as of December 2016, Build-A-Bear Workshop, Inc., operates more than 200 stores throughout the U.S.

The plaintiff is currently seeking an award for all unpaid wages for all of overtime hours that he and the class had worked. He is also seeking that award in payment and in a rate of time and one-half of the regular pay rate according to the FLSA. He is asking for a trial by jury.

The Overtime Class Action Lawsuit is Case No. 5:17-cv-03579-JLS, in the U.S. District Court for the Eastern District of Pennsylvania.
