Plaintiffs Mandy and Gary V. have filed a lawsuit against Arthrex Inc. in Ohio federal court alleging adverse effects suffered from receiving a right total knee replacement.
According to the Arthrex iBalance lawsuit, Mandy was admitted to Adena Regional Medical Center in Chillicothe, Ohio, to undergo a bilateral total knee replacement.
The product that the plaintiff had been implanted with is the iBalance knee implant system, a product manufactured by defendant Arthrex Inc.
According to the Arthrex iBalance lawsuit, there were no complications suffered from the knee replacement surgery right away.
The Arthrex iBalance lawsuit says Mandy’s left knee replacement went well. However, it was the right knee that had become an issue. The Arthrex iBalance lawsuit states that she “had increasing pain, swelling, instability in the knee and an abnormal gait due to the pain she was experiencing.”
The Arthrex iBalance lawsuit further maintains that loosening and failure had resulted. This was shown through X-ray and bone scan images. There had also continued to be “increasing pain and discomfort with hyperextension and medial lateral instability.”
According to the Arthrex iBalance lawsuit, Mandy was admitted into The Jewish Hospital in Cincinnati, Ohio, on July 12, 2016. She was admitted due to the failure of the Arthrex iBalance knee implant.
The plaintiff files the following causes of action against the defendant: 1) Negligence, 2) Product’s Liability, 3) Breach of Implied Warranty, 4) Breach of Express Warranty, and 5) Loss of Consortium.
The Arthrex iBalance Lawsuit Product Facts
The Arthrex iBalance total knee implant was recalled by the manufacturer, Arthrex Inc., over alleged manufacturing malfuncitons.
It was manufactured as a treatment for multi-compartmental knee cartilage degeneration. This is a condition which results from post-traumatic arthrosis or osteoarthritis. It was also manufactured as an additional option for patients, as an alternative to traditional total knee replacement.
The difference between Arthrex iBalance total knee and other traditional knee replacement implants is that this implant does not require another surgery to be performed. Other traditional knee replacement implants require an additional surgery for the removal of the screw and metal plate.
However, the implantation of the Arthrex iBalance total knee replacement has been requiring patients to undergo revision surgery to fix the adverse effects and complications that have resulted from its implantation.
Arthrex iBalance Total Knee Recall
The U.S. Food and Drug Administration (FDA) announced a recall of the Arthrex iBalance total knee replacement implant in March 2016. The announcement made by the federal agency was made after the company had sent out its own announcement alerts for a recall in February 2016.
The recall made by Arthrex sent out what is known as the company’s Urgent Medical Device Voluntary Recall. The announcement was sent out to surgeons, medical facilities, and distributors, advising them of the risks involved.
The FDA said in the announcement that the reason for the recall was that “Devices reported to have a smooth texture to the outer surface of the metal, which differed from a previous that had a textured outer surface.” This simply means that the product is not compatible with other rougher textured components.
The Arthrex iBalance Lawsuit is Case No. 2:17-cv-00869-MHW-EPD, in the U.S. District Court for the Eastern District of Ohio, Eastern Division.
