Tampax class action lawsuit overview:

A new class action lawsuit claims that Procter & Gamble’s Tampax brand tampons contain unsafe levels of lead.

Plaintiff Ciji Sanchez and eight others filed the class action complaint against Procter & Gamble on Nov. 19 in Ohio federal court, alleging violations of consumer protection laws.

According to the class action lawsuit, P&G’s Tampax tampons contain unsafe levels of lead, a neurotoxin associated with cognitive deficits, mental illness, dementia and hypertension.

The plaintiffs claim the company failed to disclose this risk, misleading consumers into believing the products were safe.

Lead exposure is particularly concerning in tampons, which come into direct contact with vaginal walls and the cervix, allowing lead to enter the bloodstream more easily than through oral exposure, the plaintiffs say.

The lawsuit claims that P&G knew or should have known about the lead contamination but did not disclose it on the product packaging.

The plaintiffs say they conducted independent testing that confirmed the presence of lead in the portion of the tampon that is inserted vaginally.

The lawsuit alleges that the lead levels found in Tampax tampons are significantly higher than the U.S. Environmental Protection Agency’s action level standard for lead in drinking water.

Tampax tampons allegedly mislead consumers

The plaintiffs argue that consumers reasonably expect health and hygiene products to be free from harmful contaminants like lead and that they would not have purchased the Tampax tampons had they known about the contamination.

The lawsuit also notes that other brands, including some of P&G’s own tampon lines, advertise as being lead-free, indicating that the company could have produced the products with lower or no lead levels.

The plaintiffs allege P&G’s failure to disclose the lead contamination deprived consumers of the opportunity to make informed choices between Tampax tampons and other menstrual products that do not contain lead.

The lawsuit seeks to represent anyone in the United States who purchased Tampax tampons during the relevant statute of limitations.

The plaintiffs are suing for violations of state consumer protection laws and seek certification of the class action, damages, fees, costs and a jury trial.

In a similar case, a customer recently sued Kimberly-Clark claiming the company failed to disclose that its U by Kotex Click tampons contain lead.
