A Pennsylvania woman recently filed a pedestrian hit by car lawsuit against a driver after he crashed his truck into her while she crossed a street in New York, causing serious injuries.
The plaintiff, Jeanne D., alleges that the crash occurred on April 24, 2018, when she was legally crossing a street a crosswalk in the State of New York. She claims she was suddenly struck by a vehicle driven by defendant Paul W., a New York resident, leading to serious injuries.
According to the pedestrian hit by car lawsuit, the defendant’s driving was negligent, and he failed to yield or warn her of the danger as he approached.
The injuries Jeanne sustained were substantial, and include fractures, sickness, and a snapping in left leg and ankle. Moreover, she was left unable to work as usual and has also incurred medical expenses that will continue into the future. The accident and injuries were, according to the lawsuit, “caused solely through the negligence of the defendant Paul [W.] without any negligence on the part of the plaintiff contributing thereto.”
The pedestrian hit by car lawsuit was filed on July 23, 2018, in the U.S. District Court for the Northern District of New York.
In a pedestrian hit by car accident, the victim may feel helpless in the aftermath, and they are often left to deal with medical and financial problems. However, there are options moving forward to gain some kind of compensation. Filing a pedestrian hit by car lawsuit can help to provide compensation for your injuries.
Personal Injuries
Vehicle accidents can be devastating, but those who have suffered from car accident injuries may find that filing a personal injury lawsuit can help them with compensation. Personal injury claims, like this pedestrian hit by car lawsuit, rest on the concept of negligence—that is, the idea that another party’s negligence or carelessness led directly to your injuries.
Negligence is legally defined as “the failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances to protect oneself or others from bodily injury, death, property damage.”
Filing a Pedestrian Hit by Car Lawsuit
A pedestrian hit by car lawsuit is a common form of personal injury litigation. Other personal injury lawsuits include birth injuries, slip and falls, dog bites, medical malpractice, and work injuries, among many others.
If you have a personal injury claim and want to seek compensation, you may be able to file a lawsuit. A personal injury lawsuit can help compensate for medical bills, lost income, physical pain and suffering, loss of enjoyment of life, disability or disfigurement, property damage, emotional distress, and/or wrongful death. Filing a personal injury lawsuit cannot take away the pain and suffering caused by injuries, but it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Pedestrian Hit by Car Lawsuit is Case No. 3:18-cv-00860-GLS-DEP, in the U.S. District Court for the Northern District of New York.
