A new nationwide class action lawsuit alleges OtterBox fails to honor its warranty on the replacement or repair of its smartphone and tablet cases.
Lead plaintiff Troy Button claims OtterBox violated warranty statutes, state consumer protection statutes and common law by failing to honor its warranty.
The plaintiffs argue OtterBox represents itself as one of the industry-leading brands in the smartphone protective case market, synonymous with quality and endurance, and touts “rugged protection” and “legendary drop proof protection” for its cases.
OtterBox provides an express warranty for smartphone and tablet cases “against defects in manufacturing, material or workmanship under normal use,” the OtterBox warranty class action lawsuit claims.
The plaintiffs argue the warranty period for most products is for the “lifetime of the product, which is seven years from the original date of purchase of the product by a customer or date of delivery of the product (whichever date is later) from an Otter-authorized dealer.”
OtterBox class action says company consistently ignores warranty claims
However, the plaintiffs claim they have been denied a replacement or repair for their cases which had defects in manufacturing, material or workmanship under normal use, and that were subject to OtterBox’s warranty, after submitting a valid warranty claim.
“OtterBox should be required to maintain sufficient stock in inventory to honor its warranty or repair Plaintiffs’ and Class Members’ product,” the OtterBox warranty class action lawsuit states.
The plaintiffs argue OtterBox is guilty of violations of warranty statutes and state consumer protection statutes, consumer fraud, breach of warranty, common law fraud and unjust enrichment.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of damages, treble damages, interest, costs and reasonable attorneys’ fees for themselves and all class members.
Last month, a Costco class action claimed that the company failed to include certain required repair and warranty information on the packaging of iPhones sold at its retail locations.
