A new class action lawsuit alleges that the companies behind OPMS kratom products, which operate as a single enterprise known as OPMS Kratom Enterprise, misled consumers about the addictive nature of their products.
A consumer claims the companies behind OPMS kratom products, which are derived from the leaves of the Mitragyna speciosa plant and sold in various forms, including powder, capsules and liquid extracts, engaged in false, misleading and negligent sales practices.
The consumer argues that while kratom is marketed as an all-natural product, it works on the same opioid receptors in the brain as morphine and carries similar risks of addiction and dependency.
“Kratom is perniciously addictive — on a whole different level than caffeine or nicotine — and it has sunk its hooks into tens of thousands of unsuspecting consumers and caused them serious physical, psychological and financial harm,” the kratom class action says.
The consumer seeks to represent a class of individuals who purchased OPMS kratom products in New York.
OPMS kratom companies allegedly operate as a single enterprise
The consumer argues that the OPMS kratom companies failed to disclose the risks of their products on their labeling, packaging or marketing materials. As a result, consumers who purchased and used OPMS kratom products were unaware of the potential for addiction and dependency.
“The defendants intentionally and negligently failed to disclose these material facts anywhere on the products’ labeling, packaging or marketing materials,” the kratom class action states.
The consumer further argues that the companies rely on the OPMS kratom products’ innocuous packaging and the public’s limited knowledge of kratom to get users addicted while reaping profits.
The class action lawsuit claims the companies are guilty of breach of implied warranty, unjust enrichment, fraud by omission, negligent misrepresentation and violation of New York’s General Business Law.
The plaintiff demands a jury trial and requests injunctive relief and an award of actual, statutory, compensatory and/or punitive damages for himself and all class members.
A similar class action lawsuit was filed against Ashlynn Marketing in 2023 over claims its Krave Botanicals-branded kratom products were sold in innocuous packaging that failed to indicate the serious nature of its addictiveness.

My husband has used this brand plus many others. He has shakes and feels addicted to them. He feels if he don’t take them then he will hurt.
My husband and I have been taking these products for years. 4 exactly!!! We did not know if you stop taking it, you get withdrawal symptoms that are horrible! Please help us seek justice. these companies need to be held accountable! Thank You!
I did all types of kratom since the beginning,starting with powders and krave pills. Then opms tinctures and then finally the pressed 7hydroxie pills. I’ve had issues with other things in the past and this is by far the most addictive to me. I’ve gone to rehab twice, been on medications countless times,counseling, you name it because of kratom. It almost ruined my life

This wasn’t suppose to be a drug or addictive. The package is misleading and not child proof. I was told it would help with energy. I became addicted so fast. Couldn’t stop craving it and without it I couldn’t function from withdrawal. I have had to go to rehab, out patient therapy and have an injection once a month to help block them from my system. It has been a horrible financial lose but even worse what this has done to my family. I can barely leave my house from the anxiety I feel ever since I’ve taken it and it has greatly affected my relationship with my husband (newly weds) and my 7 year old. I can’t function like I use to. It’s not right people on have class actions for the ones that died bc I’m now fighting for my life and what’s left of it. I wish I had a choice of knowing what I was really putting in my body. It’s sad I am going to have to die before anything is done. Please help me and my family.
