A California woman has filed a OneMain Financial TCPA lawsuit, claiming the loan agency violated federal law while attempting to collect a debt from her.
Plaintiff Angie H. claims that beginning in April 2016, OneMain Financial began placing calls to her cell number in order to collect an alleged debt. Numerous calls came over the next several months, she says.
In October 2016, Angie answered a call from OneFinancial and spoke with a customer service representative. This representative informed the plaintiff that OneMain Financial was attempting to collect a debt. According to this OneMain Financial TCPA lawsuit, Angie requested that OneMain cease calling her cell phone.
On the same day that she requested to stop receiving calls, she claims she received another one within minutes of the first call. She then received an additional 2 calls spaced just one minute apart.
Between Oct. 14, 2016 and Nov. 4, 2016, Angie received no less than 35 phone calls to her cellular phone from OneMain Financial, she alleges. These calls came in at a rate of between one and four calls per day. Many times she received four calls in a day, and on Oct. 31, 2016, she received four calls in one hour.
In November, Angie spoke with a representative again. This time, according to her OneMain Financial TCPA lawsuit, the representative threatened Angie. She claims the OneMain representative told her they were planning on repossessing her vehicle with the express intent of causing her so much stress that she would pay her debt.
Angie alleges that the conduct of OneMain Financial was not only willful but was done with the intent of causing her stress. She believes that she has sustained actual harm including embarrassment and mental pain and anguish.
To complicate matters, Angie is an Uber driver. Uber drivers constantly use their cellular phones in order to obtain jobs and to interact with clients.
According to Angie, her navigation app would continuously be interrupted because of the phone calls from the defendant. She claims that because of OneMain’s incessant calls, she has had negative Uber reviews and complaints about disturbances because her phone is constantly ringing.
Repeated Call Lead to OneMain Financial TCPA Lawsuit
She believes that OneMain violated the Telephone Consumer Protection Act, or TCPA. The TCPA regulates the use of automated dialing systems and artificial or prerecorded voice messages. It restricts telephone solicitations and the use of automated telephone equipment. This law also applies to SMS text messages as well as faxes.
The plaintiff brings forth two counts: violations of the TCPA and violations of the Rosenthal Fair Debt Collection Practices Act.
This OneMain Financial TCPA lawsuit is Case No. 5:17-cv-00199-BRO-DTB in the Unites States District Court for the Central District of California, Eastern Division.

I’m getting constant calls from OneMain
Onemain Financial has been harassing me as well. I received 17 calls in the past 7 days and this is just for the month of January. The list goes on from 2024 multiple calls a day. I spoke to someone in the office on 1/13/2025 and told them to stop calling my phone so many times a day, when I get the money I’ll pay. They turn around the next day and called again twice. When I answered the phone, I said I already spoke to someone yesterday and told them I’ll pay so stop calling my phone this is harassment. She stated this is a debt, I told her my account isn’t 30 days late yet. I’m very tired of this company and how they do clients. It needs to stop
I have also been harassed by them in the same way as everyone else. However I would like to add that I believe they sold my contact information to other debt/scam entities. One main was the only one that had my work extension. Not only was I getting multiple calls from them at work, I started getting a ton of scam calls to my personal work desk. No one else in my building were getting these calls. My employer has extensive phone security measures and no extensions are listed. Therefore I believe the additional scam harassment started from one main having my work number. I would be interested in hearing if anyone else notice this or a marked increase on scam calls to their cell phone after one main started harassing them.
