Biomet-logoBiomet is facing another metal hip implant lawsuit filed by a patient alleging their metal-on-metal hip implant caused serious injuries and hip complications.

Plaintiff Beverly G., an Ohio resident, filed this Biomet metal hip implant lawsuit at the end of June, claiming its M2a Magnum hip replacement system is defective and “caused her to undergo a revision surgery to remove one defective hip system and she has a second revision surgery scheduled this month,” according to her complaint.

Background on Metal Hip Implant Lawsuit

Beverly was implanted with Biomet’s M2a Magnum in her left and right hips in January 2006 and May 2007 respectively. Over time, she began to experience corrosion and friction of the allegedly defective metal hip implant caused a toxic amount of cobalt-chromium metal debris to be released in Beverly’s surrounding tissue and blood.

Because of these metal hip implant complications, Beverly was forced to undergo two hip revision surgeries in 2014 and 2015, during which the Biomet metal hip implants were removed and replaced with other hip implant products. According to the Biomet metal hip implant lawsuit:

“Undergoing two revision surgeries has subjected (Beverly) to greater risks of future complications than she had before her revision surgeries. For example, several studies have found that a revision surgery causes a much higher risk of dislocation compared with an original hip replacement surgery.”

Even after having the Biomet metal hip implant products removed from her body, the plaintiff continues to suffer permanent metallosis injuries, physical scarring, disfigurement, impaired physical mobility, mental anguish, and emotional distress.

Additionally, she has been burdened with the medical costs and expenses associated with revision surgeries and other care needed after the removal of the metal hip implants.

Beverly and her physician claim that Biomet misrepresented the safety and efficiency of the Magnum metal hip implant. Had they known of all the metal hip implant side effects associated with Biomet’s product, Beverly and her surgeon would not have chosen the Biomet metal implant for her hip replacement surgery.

This metal on metal hip implant lawsuit brings several allegations against manufacturing defect, design defect, defect due to non-conformance with representation, failure to warn, negligence, breach of express warranty, breach of implied warranty, negligent misrepresentation, fraudulent misrepresentation, fraudulent concealment, violation of the Ohio Consumers Sales Practices Act, and punitive damages.

This Biomet Metal Hip Implant Lawsuit is Case No. 3:15-cv-00270-RLM-CAN, in the U.S. District Court for the Northern District of Indiana, South Bend Division.

Background on Biomet’s Magnum Hip Replacement System

Beverly G. is not the only patient claiming that the Biomet Magnum hip replacement system failed, causing severe and often painful complications. Many individuals have reported severe and unwanted side effects from a failed Biomet metal hip implant and are now pursuing Biomet metal hip implant lawsuits or Biomet metal hip implant class action lawsuits.

According to several Biomet metal hip lawsuits and metal hip class action lawsuits, the company allegedly knew that their M2a Magnum hip implant would fail within the first couple years of implantation, whereas traditional hip implants are expected to last 10-15 years before needing replacement.

Some known metal hip implant side effects include:

  • Failure of the metal on metal hip implant requiring early replacement
  • Dislocated hip
  • Leaking of toxic substances in your bloodstream from your hip implant like chromium or cobalt
  • Cancer
  • Degenerative heart disease or cardiomyopathy
  • Loss of bone strength or structure which can result in bone fractures
  • Tissue death for any tissue surrounding the implant
  • Non-cancerous tumors or pseudotumors around the hip implant
  • Cobalt poisoning
  • Metallosis
