Norway Savings Bank class action lawsuits overview:
- Who: Three separate class action lawsuits were filed against Marquis Software Solutions Inc. and Norway Savings Bank.
- Why: The plaintiffs claim the companies failed to protect consumers’ personally identifiable information (PII) from a data breach.
- Where: The class action lawsuits were all filed in Texas federal court.
Three new class action lawsuits allege that Marquis Software Solutions and Norway Savings Bank failed to secure and safeguard personally identifiable information entrusted to them by customers.
Plaintiffs Daniel Hart, Jessica Boutot and Sally Simmering filed their class action complaints in 2025, all in Texas federal court, alleging negligence, breach of contract and unjust enrichment.
The class action lawsuits claim that a data breach in August 2025 compromised the PII of tens or hundreds of thousands of individuals, including customers of Norway Savings Bank and other financial institutions.
The lawsuits claim that the data breach exposed sensitive information, including names, addresses, dates of birth, account numbers, Social Security numbers, tax ID numbers and financial account information.
Despite having the resources to protect this information, the companies failed to invest adequately in data security measures, the lawsuits allege.
As a result, Hart says the companies’ alleged negligence has left affected individuals at risk of identity theft and other harms.
Norway Savings Bank took months to inform customers of data breach, lawsuits claim
Marquis Software Solutions and Norway Savings Bank are accused of failing to implement adequate security measures to protect customer information.
The lawsuits claim that Marquis did not have sufficient systems in place to mitigate the risks of cyberattacks, while Norway Savings Bank is accused of negligently entrusting customer data to Marquis.
The class action lawsuits allege that the companies’ response to the data breach was inadequate, with Norway Savings Bank delaying notification to affected individuals until months after the breach occurred.
The plaintiffs are looking to represent anyone whose PII was maintained by Marquis and compromised in the Norway Savings Bank data breach. They are suing for negligence, breach of implied contract and unjust enrichment and seeking restitution, damages, injunctive relief and disgorgement of profits.
In other news, Flagstar Bank reached a $31.5 million settlement with a group of consumers who claim the bank failed to protect their information in two data breaches that occurred in 2021 and 2022.
