NorthBay Healthcare agreed to pay $7.5 million as part of a settlement to resolve wage-and-hour allegations from current and former hourly health care workers.
The settlement benefits individuals employed by NorthBay Healthcare as hourly, non-exempt employees in California between Sept. 25, 2014, and Dec. 31, 2021.
NorthBay Healthcare is a healthcare system based in Solano County, California. The healthcare system includes clinics, offices and two hospitals — NorthBay Medical Center and NorthBay VacaValley Hospital.Â
According to a class action lawsuit, NorthBay Healthcare fails to pay its hourly employees the wages they deserve. This allegedly includes minimum and overtime wages.Â
In addition, plaintiffs in the class action lawsuit contend the company fails to provide meal and rest breaks, accurate, itemized wage statements and other benefits promised to them under state and federal law.
The wage and hour class action lawsuit includes claims under the federal Fair Labor Standards Act (FLSA), California labor laws and the California Private Attorneys General Act (PAGA), which allows workers to take legal action on behalf of the state’s Labor Workforce Development Agency (LWDA).
NorthBay Healthcare hasn’t admitted any wrongdoing but agreed to resolve these claims with a $7.5 million class action settlement. A portion of the settlement will be considered a PAGA payment, most of which will be given to the California LWDA as penalties.
Under the terms of the settlement, class members will receive a cash payment based on the number of workweeks they worked during the class period.Â
Class members who worked only a few shifts during this period will receive a smaller share of the settlement fund than those who worked consistently throughout the entire period.Â
Mailed notices included class members’ total workweeks worked. Class members can dispute this number by Sept. 6, 2022, if they believe they worked more than the listed number of workweeks during the class period.
Class members will receive their payment as two checks.Â
One check of up to $50 will be considered an FLSA release, while the other will be considered a release of state wage-and-hour claims. Twenty-five percent of each payment will be treated as unpaid wages, and the remaining 75% will be treated as interest and unpaid penalties.Â
Class members may wish to speak with a tax professional about the consequences of these payments.
The deadline for exclusion and objection is Sept. 6, 2022.Â
The final approval hearing for the NorthBay Healthcare settlement is scheduled for Nov. 16, 2022.
No claim form is required to benefit from the health care workers settlement. Class members who do not opt out will automatically receive a settlement payment.
