A new NordVPN class action lawsuit alleges the company uses deceptive and illegal automatic renewal tactics to trick consumers into paying for unwanted subscriptions.
Plaintiff Lanzy Kandeh filed the NordVPN class action lawsuit against Nordvpn S.A., Tefincom SA and Nordsec B.V. on March 28 in New York federal court, alleging violations of state consumer laws.
NordVPN is a virtual private network service provider that offers products and services that claim to provide internet users with privacy and protection from cybersecurity threats.
Kandeh claims Nord Security misleads consumers into thinking they can subscribe to privacy product offerings for a discrete period of time.
However, the plaintiff alleges the company hides disclosures concerning automatic renewal, which falls short of the legal requirements for such a subscription.
NordVPN makes subscriptions difficult to cancel, lawsuit alleges
Kandeh alleges Nord Security intentionally makes subscriptions difficult to cancel and fails to provide adequate notice of material changes to those subscriptions.
The plaintiff claims Nord Security’s product offerings have a “negative option” feature, which means the company may interpret a consumer’s silence, failure to take an affirmative action to reject a product or service or failure to cancel an agreement as acceptance or continued acceptance of the offer.
The lawsuit alleges Nord Security’s subscription scheme hits the Consumer Financial Protection Bureau’s warning trifecta of 2023, as the company misleads consumers about terms and conditions, fails to obtain consumers’ informed consent and makes it difficult for consumers to cancel.
As a result, Kandeh claims many consumers who sign up for Nord product offerings ultimately end up paying for subscriptions they do not want.
The plaintiff is looking to represent anyone in New York who was automatically enrolled into and charged for at least one month of Nord Security membership by the company at any time from the applicable class period to the date of judgment.
He is suing for violations of New York’s consumer protection laws and seeks certification of the NordVPN auto-renewal class action, damages of at least $50 million, fees, costs and a jury trial.
In 2024, a consumer filed a similar complaint in Colorado against Nordvpn S.A. and Tefincom S.A., alleging NordVPN employs deceptive automatic renewal practices that trap consumers into costly, unwanted subscriptions.
