Yet another class action lawsuit alleges Nord Security misleads consumers into paying for unwanted subscriptions to its internet privacy and security products.
Nord Security offers a range of products and services designed to protect internet users’ privacy and guard against cybersecurity threats. These include the virtual private network service “NordVPN,” the password manager “NordPass,” and the encrypted cloud storage solution “NordLocker.”
Plaintiff Michael Sasgen filed the class action complaint against NordVPN and Tefincom on June 20 in Illinois federal court, alleging violations of state and federal consumer protection laws.
Sasgen argues Nord Security uses deceptive “automatic renewal” tactics to trick consumers into paying for unwanted subscriptions for internet privacy and security products.
This comes after a similar class action in May by a New York plaintiff and in late 2024 by a Colorado resident also alleging deceptive renewal tactics.
Sasgen claims Nord Security fails to properly disclose that its subscriptions automatically renew and makes it difficult for consumers to cancel them, which is in violation of Illinois’ Automatic Contract Renewal Act.
The plaintiff argues Nord Security hides its disclosures about ongoing charges, both before and after purchase, and fails to provide adequate notice of material changes to its subscriptions.
Nord Security ‘hides disclosures’, class action alleges
Sasgen claims Nord Security’s subscription scheme is designed to trick consumers into paying unwanted fees, with the company using a “negative option” billing tactic that interprets a consumer’s silence or failure to cancel as acceptance of the offer.
The Nord Security class action lawsuit argues the company’s enrollment process misleads consumers about automatic renewal terms, with disclosures buried in a drop-down feature that customers do not see unless they click on it.
Sasgen claims Nord Security also charges customers 14 days before their subscription term ends, making it difficult for them to cancel before being billed for another year.
The plaintiff argues Nord Security’s cancellation process is intentionally difficult, requiring customers to navigate multiple layers of account settings to find a buried option to turn off auto-renewal.
Sasgen wants to represent anyone in Illinois who was automatically enrolled into and charged for at least one month of Nord Security membership. He demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages for himself and all class members.
