pregnancy birth defectsA new Zofran birth defects lawsuit was filed in a federal court against GlaxoSmithKline and Sandoz Inc, alleging that a young child suffered serious injuries due to hisprenatal exposure to the prescription medication.

The birth defects lawsuit was brought by Sierra E. and Antoine E., residents of Idaho and Maryland, individually and on behalf of their minor child.

According to the Zofran birth defects lawsuit, Sierra was prescribed and used Zofran during her first trimester in order to relieve symptoms of morning sickness.

The birth defects lawsuit alleges that prior to the birth of Sierra and Antoine’s child, an ultrasound showed the unborn infant suffered from several serious birth defects.

These birth defects included craniofascial defects primarily cleft alvedus and ear deformities. His parents had genetic testing performed to determine whether these defects were the result of genetic anomalies. When testing was performed, no genetic anomalies were discovered.

The parents argue that GlaxoSmithKline has caused devastating lifelong and irreversible suffering for numerous newborns and their families.

Once Sierra and Antoine had their child, the infant had to undergo multiple corrective surgeries because of the alleged Zofran birth defects.

The child’s parents allege that due to these defects, he has been unable to develop fully and enjoy life; they further claim that his defects have subjected him to teasing and bullying.

Background on Zofran

Zofran is a popular anti nausea medication used to treat the most severe nausea. It is primarily prescribed to patients who have undergone radiation or chemotherapy treatments.

Zofran was approved by the FDA back in 1991 and has grown in popularity since then. The medication is manufactured and marketed by GlaxoSmithKline and distributed by Sandoz Inc.

While it is illegal for pharmaceutical manufacturers to advertise medications for non FDA approved uses or off-label uses, it is not illegal for doctors to prescribed medications for these purposes.

Zofran is not FDA approved to treat morning sickness in women that are pregnant, and studies have shown that when the medication is taken, especially during the first trimester, the unborn fetus is placed at a serious risk of birth defects.

Numerous Zofran lawsuits allege that GlaxoSmithKline illegally advertised and marketed Zofran as a safe anti-nausea medication for women experiencing morning sickness.

Plaintiffs of these Zofran cases claim that even though the drug company advertised the anti nausea medication was safe for pregnant women, GlaxoSmithKline failed to perform any studies to prove or disprove this assertion.

Zofran lawsuits have been filed in several U.S. Courts. Product liability attorneys are currently looking for potential plaintiffs to bring Zofran lawsuits against GlaxoSmithKline.

Awards and settlements from these lawsuits will help victims pay past or future medical bills. These monetary awards will also serve as a small step towards compensating victims for the pain and suffering they have been forced to endure due to the medication.

Whether or not a person should bring a Zofran lawsuit is a decision that should be made on a case by case basis with the advice of a legal professional.

The Zofran Birth Defects Lawsuit is Case No. 1:15-CV-00319-BLW, in the U.S. District Court in the District of Idaho in the Southern Division.
