Hyundai fuel economyHyundai Motor Co. has been hit with yet another class action lawsuit over the “MPG Gate” revelation that Hyundai overestimated the fuel efficiency of six of its 2012 and 2013 models, including the popular Elantra, Sonata and Tucson.

Lead plaintiff Edwin Naythons alleges in the latest Hyundai fuel economy class action lawsuit that the Korean automaker sold and leased “tens of thousands” of cars displaying window stickers that contained false and inflated gas mileage estimates and fuel economy ratings, in violation of the New Jersey Consumer Sales Practices Act. These cars include the 2012-2013 Hyundai Elantra, Sonata, Sonata Hybrid, Accent, Genesis, Santa Fe, Azera, Tucson and Veloster models.

“Consumers reasonably rely on the gas mileage estimates and fuel economy ratings contained on vehicle window stickers and featured in manufacturers’ websites, brochures and advertisements to help them make informed choices about the vehicles they purchase,” Naythons says in the Hyundai class action lawsuit.

Naythons joins several other consumers that filed class action lawsuits against Hyundai following a U.S. Environmental Protection Agency (EPA) investigation that revealed Hyundai had issued incorrect mileage estimates for the majority of its 2012 and 2013 models. Actual mileage ratings varied from 1 mpg to as much as 6 mpg less than advertised, spawning a flurry of class action lawsuits by angered Hyundai owners.

According to Naythons’ class action lawsuit, the fleet average of all Hyundai models is 3 percent worse than advertised.

At least one of the Hyundai MPG class action lawsuits has been tentatively certified based on evidence that Hyundai’s marketing efforts were extensive enough that consumers could have relied on the ads in making their purchasing decision, the judge said.

Naythons is seeking to represent a nationwide class of consumers that leased or purchased a Hyundai vehicle containing a manufacturer’s window stick with inflated gas mileage and fuel economy statements.

The latest Hyundai Fuel Economy Class Action Lawsuit case is Edwin Naythons v. Hyundai Motor Co., Case No. 12-cv-07428, U.S. District Court for the District of New Jersey. UPDATE 1: Hyundai and Kia reached a $400 million class action lawsuit settlement in February 2013, which was announced in December 2013. 

UPDATE 2: A group of breakaway Class Members filed an objection to the proposed Hyundai Kia class action lawsuit settlement, calling it “unreasonable” and “unfair” to consumers.

UPDATE 3: As of Apr. 11, 2016, six different appeals have been filed concerning the Hyundai Fuel Economy Settlement. Until the Court resolves those appeals, the Claims Administrator is unable to mail out settlement funds.

    I have a 2013 Hyundai Sonata which I fuel my car twice in a weeks time filling it up both times. March 17, 2015, March 28, 2015 and getting ready to fuel it again March 31, 2015. I should be getting a better gas mileage than what I’m getting.

    I would also like to join the newest class action suit against Hyundai, Edwin Naythons v. Hyundai Motor Co. My 2012 Sonata get much lower gas mileage than advertised. Can someone please provide details on signing up?

    bought a 2013 sonata based on the gas milage represented. getting avg 22 miles per gallon. my wife mostly drives on the highway. This is a gross misrep by the company and when you spend 20K on a car you exptect to get close to what is adverstised.

    I just purchased a 2011 Genesis as a new car with 7000 plus miles, the first three weeks of owning this car I have spent over $300.00 in gas to, my daily travel is 60m miles a day and 304 for the week. Dealership has not honored my concerens of the gas mileage and the probelms I having with the stero system. I very much want to be apart of the class action suit.
