An Oklahoma woman recently added yet another baby powder cancer lawsuit to the growing litigation against pharmaceutical giant Johnson & Johnson, alleging that the company’s popular baby powder products, made with talc, led directly to her diagnosis with ovarian cancer.
The plaintiff, Margaret B., says she has essentially used Johnson & Johnson talc baby powder all her life. She was born in 1961, when the powder was administered to her as an infant. She simply continued her use of the product into her adult life, following Johnson & Johnson’s heavy marketing of the product as an essential feminine hygiene product. Unfortunately, Margaret was diagnosed with ovarian cancer in January 2010.
After discovering a connection between talc baby powder and ovarian cancer, Margaret immediately stopped her usage of the product, but it was too late. She ended up filing a baby powder cancer lawsuit against Johnson & Johnson over her injuries.
Margaret filed her powder cancer lawsuit on Sept. 5, 2017 in the U.S. District Court for the District of New Jersey. She filed on multiple counts, including failure to warn, defective manufacture and design, breach of express and implied warranties, negligence, fraud, civil conspiracy, and several others.
Baby Powder Ovarian Cancer
Talc-based products, including Johnson & Johnson’s popular Shower to Shower baby powder, have been widely used for decades. Although baby powder is primarily used for babies to prevent diaper rash, it is also commonly marketed as a feminine hygiene product. Many women use baby powder products regularly in the genital area, and Johnson & Johnson hasn’t discouraged this usage, lawsuits claim.
Indeed, plaintiffs say, Johnson & Johnson has even actively encouraged female consumers to use its talc baby powder products for personal hygiene uses, failing to effectively warn about the serious risks linked with this kind of usage.
Lawsuits like this one claim that Johnson & Johnson was either misrepresenting or outright deceiving customers to the actual safety of talc powder as a personal hygiene product, concealing some rather serious risks.
Danger of Ovarian Cancer
Ovarian cancer brings with it very few early symptoms, meaning that it is not usually discovered until the disease has moved into its later and more dangerous stages. This is part of the reason ovarian cancer is so deadly. In fact, it is the fifth leading cause of cancer death in U.S. women.
Once a patient reaches the later stages of ovarian cancer, any possible treatment will become much less effective, and the fatality rate soars.
Filing a Baby Powder Cancer Lawsuit
If you or someone you love has used Johnson & Johnson’s Shower to Shower or a similar talc baby powder product, especially as part of a regular hygiene routine, and have since been diagnosed with ovarian cancer, you may be able to file a baby powder cancer lawsuit. Lawsuits allege that Johnson & Johnson failed to warn consumers about the link between its talc powder products and ovarian cancer.
While filing a baby powder cancer lawsuit cannot take away the pain and suffering of a patient suffering from ovarian cancer, and cannot bring a loved one back to life, it can at the very least help to alleviate the financial burden caused by medical expenses and lost wages.
The Baby Powder Cancer Lawsuit is Case No. 3:17-cv-06771-FLW-LHG, in the U.S. District Court for the District of New Jersey.
