A husband and wife recently filed an Actos lawsuit against Takeda Pharmaceuticals in federal court. Plaintiffs Gary G. and Lorrie G. filed the lawsuit for injuries sustained after Gary was prescribed Actos, a type-2 diabetes medication. Research has linked ingesting Actos for a period of a year or more to an increased risk of developing bladder cancer.

According to the lawsuit, Gary was prescribed Actos by a medical professional in 2004. He continued to use the medication for seven years, until 2011. Three years later, in November 2014, Gary was diagnosed with bladder cancer.

Gary’s Actos lawsuit against Takeda Pharmaceuticals claims that the drug manufacturer concealed its knowledge of Actos’ unreasonably dangerous risks from the medical community and the general public. Gary claims that had he been aware of the risks associated with taking Actos he would have chosen a different medication to regulate his type-2 diabetes. The Actos lawsuit asserts claims for negligence, product liability, and breach of warranty.

Lorrie, Gary’s wife, joined the Actos lawsuit as a co-plaintiff in order to bring a loss of consortium claim against Takeda. Her claim alleges that the injuries Gary incurred from taking Actos has cost her the loss of companionship, society, and services of her spouse. In her claim she states she has suffered mental anguish and has become liable to pay for medical aid, treatment, medications, and various other expenses related to Gary’s injuries.

The lawsuit filed by Gary and Lorrie against Takeda is just one of many Actos lawsuits awaiting trial in federal court. These Actos lawsuits are a part of a multidistrict litigation panel that places similar cases before the same tribunal for pretrial proceedings. This is done in hopes of creating consistent and efficient outcomes for all parties involved.

Hundreds of bladder cancer lawsuits have been filed nationwide by patients who have suffered serious side effects associated with the Actos diabetes medication. Family members who have lost loved ones to Actos side effects have also begun filing wrongful death lawsuits against Takeda.

What is Actos?

According to the Actos lawsuit, type-2 diabetes is the most common form of diabetes in the United States. A person develops type-2 diabetes when their body does not produce enough insulin and/or their body does not efficiently use the insulin it does produce. Human bodies require insulin to transform glucose into energy. Actos was approved by the U.S. Food and Drug Administration to treat type-2 diabetes back in 1999. That same year Takeda began marketing Actos to the public.

Actos, also known as pioglitazone, belongs to a class of insulin sensitizing diabetes agents known as thiazolidinediones. The medication helps the human body more efficiently use the insulin it naturally produces and also prevents the liver from making too much insulin. Unfortunately, Actos also reportedly causes a 40 percent increased risk of developing bladder cancer in patients who take the medication for a period of more than 12 months.
