
Navient Solutions Inc. is facing a new Telephone Consumer Protection Act (TCPA) lawsuit, after allegedly placing numerous unwanted phone calls to a collect on a student debt.
The student loan company allegedly conducted these TCPA violations willfully, as the claimant repeatedly asked the company to stop calling.
Mississippi plaintiff Ellen S. is filing the Navient TCPA lawsuit, alleging the company placed these phone calls using an automated dialing system and did not adhere her requests to stop calling.
According to the Navient TCPA lawsuit, Navient placed over 200 calls to Ellen’s cellphone since the company began calling her in January 2016.
Furthermore the Navient TCPA lawsuit indicates the phone calls were relentless, with 30 calls placed to Ellen’s cellphone between Feb. 01, 2016 and Feb. 05, 2016 alone. Navient reportedly placed these calls, trying to collect on a student loan.
Over the course of this year, Ellen repeatedly asked Navient to cease calling her and still received the persistent phone calls.
Based on the numerous phone calls placed in the short time span, as well as the artificial sounding voice that spoke when the call was answered, Ellen’s lawyers state that an automated dialing system was most likely used.
Ellen is filing this Navient TCPA lawsuit, alleging the company violated federal privacy laws and caused her financial damages by incurring charges on her cellphone.
Overview of TCPA Allegations
The TCPA was passed by Congress in the early 1990s in order to help combat aggressive telemarketing and debt collection practices from companies.
Under the TCPA, companies are prohibited from using automated dialing systems to look up or generate phone numbers to dial.
Classic signs of automated dialing system are an artificial or pre-recorded voice speaking, if the call is answered by the recipient.
In addition, the TCPA requires companies to keep a do-not-call registry that must be honored for at least several years. If a consumer asks the company to cease contacting them, their name must be added to the registry.
Similarly, the TCPA also requires companies to gain express consent from the recipient before placing the calls.
TCPA fees can range between $500 to $1500 per violation, with the penalties ranging on the larger side if willful violation is proven.
Ellen’s Navient TCPA lawsuit points out that Navient has faced similar allegations in the past, it indicates the company knowingly violated the federal policy.
Ellen is seeking all relevant damages for TCPA violations, alleging the violations are willful.
The Navient TCPA lawsuit is Case No. 4:16-cv-214-DMB-JMV, in the U.S. District Court for the Northern District of Mississippi, Greenville Division.

Never rec’d anything from either alleged companys but relentlis phone calls.
How do I get in this lawsuit? They are relentless calling at least 25+ times a day…. No matter how many times you tell them not to call they do not listen!!! And on top of calling they also will send emails and certified letters and UPS packages… Its all too much with them!!!
