A new class action lawsuit claims that Natural Cycles shared users’ reproductive health data with third parties without their consent.
Four anonymous plaintiffs, known by the initials S.A., S.S., A.S. and M.F., filed the Natural Cycles class action lawsuit against NaturalCycles USA and NaturalCycles Nordic on Dec. 4 in California federal court, alleging violations of state privacy laws.
Natural Cycles is a fertility tracking and digital birth control application that markets itself as a privacy-protective medical device cleared by the U.S. Food and Drug Administration, the plaintiffs say.
Their class action lawsuit alleges the app assures users that their sensitive health information will remain confidential and will never be shared with third parties without consent.
However, the plaintiffs claim Natural Cycles embedded hidden tracking technologies from third parties like Mixpanel, AddShoppers, Google and TikTok.
These tracking tools allegedly captured users’ reproductive and sexual health data in real time and transmitted it to third parties, the plaintiffs say.
Natural Cycles allegedly shared data about users’ pregnancy status, menstrual cycle, fertility goals, sexual activity, contraceptive use and medical conditions.
Class action: Natural Cycles’ conduct violated California laws
The plaintiffs claim Natural Cycles assured users that it would protect their data privacy and charged a subscription fee to do so.
Despite these assurances, the plaintiffs claim Natural Cycles shared users’ data with third parties for advertising and commercial purposes.
The plaintiffs allege Natural Cycles violated the California Confidentiality of Medical Information Act and the California Invasion of Privacy Act.
They are looking to represent a class of Natural Cycles users in California who entered reproductive health information into the app. The plaintiffs are suing for violations of state privacy laws and seeking certification of the class action, damages, fees and costs and a jury trial.
Meanwhile, Northwell Health recently agreed to settle class action claims that it shared patient information with third parties, such as Google and Facebook, without consent.
