Total Wireless class action lawsuits overview:

  • Who: Three consumers filed separate class action lawsuits against Veriff OU and Verizon Value Inc., doing business as Total Wireless.
  • Why: They claim Veriff and Total Wireless failed to adequately protect customers’ personally identifiable information (PII) from a data breach.
  • Where: The Total Wireless class action lawsuits were all filed in New York federal court.

Three new class action lawsuits allege that Total Wireless and Veriff failed to adequately protect customers’ personally identifiable information from a data breach.

Plaintiffs claim Veriff experienced a cyber incident in which an unauthorized third-party gained access to its IT network, compromising customers’ PII. 

Plaintiff Kelly McLaughlin, an Oregon resident, alleges that unauthorized access took place on or around Nov. 18, 2025, and was detected on Dec. 10, 2025, noting that Total Wireless filed an official notice with the Maine Attorney General on Jan. 9, 2026.

All three plaintiffs argue Veriff and Total Wireless were negligent in protecting the PII of their customers, which was left unencrypted and unredacted.

“Defendants failed to adequately protect the plaintiff’s and class members’ private information,” plaintiff Dustine Reed alleges in his class action lawsuit. “This unencrypted, unredacted private information was compromised due to the defendants’ negligent and/or careless acts and omissions and their utter failure to protect the plaintiff’s and class members’ sensitive data.” 

Lawsuits allege data breach put customers at risk of identity theft

Plaintiff Trina Stockton, a Colorado resident, claims Veriff and Total Wireless failed to implement and maintain adequate data security measures, leaving their customers vulnerable to identity theft and fraud.

“Hackers targeted and obtained the plaintiff’s and class members’ private information because of its value in exploiting and stealing the identities of the plaintiff and class members,” the Total Wireless class action lawsuit says.

Reed, an Ohio resident, further alleges that “the present and continuing risk of identity theft and fraud to victims of the data breach will remain for their respective lifetimes.”

The plaintiffs want to represent a nationwide class of individuals residing in the United States whose PII was accessed and/or acquired by an unauthorized party as a result of the data breach and received a notice letter from the defendants.

Meanwhile, Comcast recently agreed to pay $117.5 million to resolve claims it failed to protect the personal information of more than 31 million customers.
