Essure gynecologist doctor patientMany women are coming forward and filing an Essure birth control lawsuit against Bayer, the product’s manufacturer.

The pharmaceutical company is being sued over accusations of concealment and false advertisement of the Essure permanent birth control product.

The plaintiffs in the most current Essure birth control lawsuit are Alecia M., Marta B., Viridiana M., and others. The lawsuit was recently filed on Dec. 19, 2017 in St. Louis Circuit Court.

The women accuse the company and its named defendants of partaking in systematic false, widespread, and illegal promotional activity to urge patients and physicians to use the permanent birth control device. In doing so, the defendants allegedly failed to warn patients of the risks and complications involved in being implanted with the Essure product.

The women file the Essure birth control lawsuit requesting a trial by jury. They seek costs of the proceeding, judgment for damages, and just and proper relief.

Essure Overview

Essure, manufactured by Bayer Healthcare, was thought to be a breakthrough permanent contraceptive device for women wanting to be sterile for life. However, there have been unsurmountable adverse effects and complications linked to the permanent contraceptive device.

Some of these serious complications include allergic reactions, organ perforation, pelvic pain, excessive bleeding, miscarriage, and ectopic pregnancy. Women filing an Essure birth control lawsuit assert that they were never warned about these serious complications linked to the device.

The Essure device is a permanent contraceptive device that is implanted through a woman’s vagina and uterus through a non-surgical implantation procedure.

The Essure device comes with two flexible coils that are composed of polyester and metal. These coils are implanted within a woman’s fallopian tubes, and throughout the course of a few months, tissue develops around them, blocking conception.

Once the coils are implanted, a woman returns to her physician in a few months to confirm that the procedure was successful and that contraception is no longer possible.

The U.S. Food and Drug Administration (FDA) approved Essure in 2002. However, it was approved through the agency’s fast track approval system because it allowed women a faster recovery time and an alternative to surgical sterilization. Critics say that because of this less rigorous procedure, the Essure coils were approved prior to sufficient and adequate studies looking in to the device.

Although touted as providing quicker recovery time and offering a safer alternative to surgical sterilization, the device has led to more than 4,500 adverse event reports filed with the FDA pertaining to Essure adverse effects and complications.

As contended through the most recent lawsuit filed against Bayer, the manufacturer misleadingly represented Essure’s safety as being a permanent birth control device.

Plaintiffs filing Essure lawsuits challenge Essure’s quick approval through the FDA’s fast track approval system, stating that the approval was based on questionable studies. They contend that Essure should have been further studied before ever being placed on the market.

In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
