intrauterine device (IUD)More than 2,000 Mirena IUD lawsuits have been filed in New York and New Jersey federal courts.

Many of the Mirena IUD problems stem from the Bayer birth control product allegedly migrating from the implant site in the uterus, which then causes women to sustain severe and sometimes permanent injuries.

The Mirena IUD is a t-shaped, plastic birth control device that releases incremental doses of levonorgestrel into a woman’s bloodstream. Mirena is meant to “thicken cervical mucus, thin the uterine lining, inhibit sperm movement and reduce sperm survival to prevent pregnancy,” according to Bayer’s marketing and product packaging. Because the Mirena IUD is a low maintenance form of long-term birth control, it is an appealing option to most consumers, especially women who have already had children.

The various Mirena lawsuits have been filed in New York federal court and have similar allegations against Bayer Healthcare Pharmaceuticals, and detail similar Mirena complications. For example, some Mirena IUD problems claimed by several women in these Mirena IUD lawsuits include: uterine perforation, scarring, infection, subsequent infertility, and other Mirena complications stemming from the migration of the IUD from the properly implanted position.

Many of the plaintiffs of these Mirena personal injury lawsuits allege Bayer downplayed, and even hid all the risks associated with using the Mirena IUD. Plaintiffs further allege Bayer failed to warn consumers and healthcare providers that the birth control device might migrate after it was properly implanted in the uterus by a licensed physician. Furthermore, the product label allegedly only mentioned that IUD migration was likely to happen if uterine perforation occurred during Mirena IUD implantation.

Currently, there are 1,042 Mirena complications lawsuits pending trial in in the multidistrict litigation In re: Mirena IUD Products Liability Litigation, MDL No. 2434,  in the U.S. District Court for the Southern District of New York.

Aside from the thousand plus Mirena IUD problem lawsuits filed in New York federal court, there are an additional 1,100 Mirena complications lawsuits pending multidistrict litigation as a part of In Re: Mirena Litigation, MDL Case No. 297, in New Jersey’s Bergen County Superior Court.

Mirena IUD Problems and Side Effects

Bayer reportedly did not alter its product packaging even after a number of reports documenting hundreds of incidences of “embedment of and perforation through the uterine lining and/or migration of the IUD through the uterine lining after the period of insertion.” Migration, embedment, and perforation are just some of the reported Mirena complications. Despite these reports and additional FDA’s warnings, Bayer has continued to manufacture and sell Mirena IUD.

  • Breast pain/tenderness
  • Perforation

  • Ectopic/intrauterine pregnancy

  • Fetal injury/death
