Texas plaintiff Alyson C. is suing Bayer Pharmaceuticals for the injuries she allegedly suffered from using the Bayer contraceptive Mirena IUD. Alyson claims she developed non-cancerous cysts inside her ovaries and had to undergo to surgery to remove them as a result of using Mirena.
The plaintiff alleges in the Mirena lawsuit that she chose the IUD as her primary choice of birth control for its conveniences and longevity. The product had been inserted into her by her physician in February 2009 and was properly placed inside her uterus, according to the Mirena lawsuit. Ideally, the plaintiff could use the reportedly hassle-free birth control method for up to five years.
This allegedly did not end up being the case for Alyson as the IUD had to be removed after she started experiencing painful side effects. The Mirena lawsuit says the IUD initially worked well for the plaintiff but she started feeling pain in October 2012 and had to undergo various medical testing by her physician to identify the problem. She was officially diagnosed on Dec. 12, 2012 with the formation of two ovarian cysts, one on each ovary, after she underwent medical digital imaging, the Mirena lawsuit alleges.
Luckily, permanent damage was avoided for the plaintiff as the Mirena IUD was removed the day the cysts were discovered and had the cysts were eliminated soon after. However, her physician warned her that her ability to have a child may have become compromised due to the invasive surgery performed on her ovaries. So even if the plaintiff is no in danger, there is a strong possibility that her life has been permanently compromised, according to the Mirena lawsuit.
After learning of the various potential side effects of Mirena, which included the development of non-cancerous cysts, Alyson filed this product liability lawsuit against Bayer Pharmaceuticals. As the manufacturer of the device, the plaintiff states that the company was directly responsible for her injuries because they failed to warn her of these potential Mirena IUD complications.
Additionally, her lawyers claim that the company had the civil duty of warning their client and the general public of these potential Mirena IUD complications because they rely on the given information provided with the product. Alyson states that she never would have used the Mirena IUD if she had known about the possibility of ovarian cyst formation.
So for being allegedly responsible for manufacturing, selling, distributing, and marketing an allegedly dangerous product, Alyson is suing Bayer Pharmaceuticals. The charges include: negligence, false advertising, concealing information, and misrepresenting a product.

Overview of Mirena IUD Complications

The Mirena IUD is a t-shaped intrauterine device that is directly inserted into the woman’s uterus and is designed to last up to five years.
