Mirena IUD lawsuits pending in a New Jersey state court are moving forward as trial dates are about to be set, which will be an aid to future juries when other Mirena lawsuits make their way through the court system.
Bayer Healthcare Pharmaceuticals is headquartered in New Jersey, which is why more than 800 of the Mirena IUD lawsuits outstanding are filed in the New Jersey state courts. In order to lessen duplicative discovery, reduce the potential of conflicting trial rulings, and for the convenience of all parties, the Mirena IUD lawsuits were centralized in Bergen County as part of a coordinated Multicounty Litigation (MCL). Superior Court Judge Brian R. Martinotti is presiding over this consolidation.
Mirena IUD lawsuits have been filed in other states, as well. In the New York courts, Judge Cathy Seibel is presiding over a federal MDL with more than 500 Mirena IUD lawsuits.
In May, Judge Martinotti directed lawyers of both parties to submit eight cases each from the hundreds for review for the first New Jersey state court Mirena trials. Additionally, in the federal Mirena MDL, a select group of lawsuits are also being prepared for early trial dates.
The hope is that the first New Jersey Mirena trials should begin in the latter half of 2015.
Mirena IUD Complications
In 2000, Bayer introduced the Mirena IUD. An IUD is a small, “T-shaped” device inserted into the uterus by a healthcare professional. Releasing small doses of hormones, IUDs were traditionally known as a safe, effective, and a long lasting method of birth control.
The Mirena IUD was marketed as a stress-free form of birth control with a five year life span. Once inserted, it releases a synthetic hormone (levonorgestrel, a progestin) into a woman’s body to aid in preventing pregnancy. Regular Mirena IUD side effects can include pelvic or abdominal pain and heavier bleeding for a few weeks after insertion.
However, since 2000, more than 70,000 adverse events have been filed with the U.S. Food and Drug Administration involving Mirena side effects. These issues include Mirena IUD migration and uterine perforation, going far beyond the realm of expected Mirena IUD side effects, which is why there were an increasing amount Mirena IUD lawsuits.
Mirena has more than 2 million users in the United States, and currently around 2,000 product liability lawsuits. Women filing the Mirena lawsuits against Bayer allege their Mirena IUD caused pain and suffering, migrating to other areas of their body after insertion, enabling unplanned or ectopic pregnancies, perforating the uterus, and causing other internal injuries.
Warning Label Doesn’t Tell All
Plaintiffs around the country allege Mirena’s label does not warn about spontaneous migration of the Mirena IUD, but only states that migration may occur if the uterus is perforated during insertion. Moreover, perforation is described as an “uncommon” event on the packaging label. They allege that this warning label is inadequate to properly warn consumers of all the Mirena IUD side effects. The Mirena IUD lawsuits allege that Bayer knew of the risks but concealed information and misrepresented the product
