A woman has filed a Mirena IUD lawsuit against Bayer for failing to warn against the health complications that the Virginia resident allegedly suffered as a result of using the birth control device.
Gail M., 53, began to use the Mirena IUD on March 28, 2007. In 2009, she was told that the “Mirena IUD had perforated and migrated outside her uterus and was in her left pelvis,” according to the Mirena IUD lawsuit. Gail had to undergo laparoscopic surgery in order to recover the device.
Gail claims that the injuries she suffered and the significant costs she incurred were “a direct and proximate result of [Bayer’s] negligence and wrongful conduct.”
Mirena IUD Side Effects and Warnings
The Mirena IUD is a t-shaped intrauterine birth control device that is inserted into the body by a healthcare provider. The Mirena IUD can stay in the uterus for up to five years. Millions of women have chosen this form of birth control and might continue to choose to use this device because they are not required to take a daily pill.
The Mirena IUD lawsuit listed possible Mirena side effects including perforation, migration, ectopic pregnancy, cancer, fetal injury, early/premature menopause, and other potentially dangerous and painful conditions.
These conditions were allegedly concealed by Bayer, according to the Mirena IUD lawsuit.
In 2009, the Department of Health and Human Services Division of Drug Marketing, Advertising, and Communications (DDMAC) warned that Bayer had “failed to communicate any risk information … and overstated the efficacy associated with” the Mirena IUD.
Mirena IUD Lawsuit
This Mirena IUD lawsuit includes counts of negligence, defective design, manufacturing defect, failure to warn, failure to adequately test, breach of warranty, fraudulent misrepresentation, concealment, negligent misrepresentation, fraud and deceit.
Gail is seeking damages for past and future injuries including the initial pain and suffering allegedly caused by the Mirena IUD device, the surgery to remove the device, and other health care costs. She is also seeking punitive and/or exemplary damages for the poor behavior allegedly shown by Bayer.
Over 2,000 Mirena lawsuits have been filed by women over the past several years who allegedly suffered medical complications caused by the Mirena IUD. Side effects include pelvic pain, infection, perforation of the uterus or cervix, and others. Mirena IUD lawsuits claim Bayer not only over-promoted the benefits of the device but failed to warn about serious health complications.
