A new Mint Mobile class action alleges the telecommunications company recorded phone calls with consumers without their knowledge or consent.
Plaintiff Greg May filed the class action lawsuit against Mint Mobile on March 5 in a California state court, alleging violations of California’s Invasion of Privacy Act.
The lawsuit claims Mint Mobile recorded phone conversations with its customers without their consent, in violation of California Penal Code Section 632.7.
The class action lawsuit alleges Mint Mobile routinely recorded calls with consumers who contacted its customer service line without informing them that the calls were being recorded.
The California Invasion of Privacy Act, enacted in 1967, protects the privacy rights of California citizens by prohibiting the recording of communications without the consent of all parties involved, the class action explains.
In 1992, the law was amended to include Section 632.7, which extends the protections to cellular and cordless telephone conversations, the lawsuit says.
Mint Mobile failed to disclose recording policy, class action says
May alleges that he called Mint Mobile’s customer service number in December 2024 to inquire about wireless service plans. During the call, he was not informed that the conversation was being recorded, the lawsuit says.
The lawsuit claims Mint Mobile has a policy of recording all incoming and outgoing calls but systematically failed to disclose this to consumers.
May seeks to represent all California residents who had a phone conversation with Mint Mobile on a cellular phone that was recorded without their consent within one year preceding the filing of the Mint Mobile privacy policy class action lawsuit.
The lawsuit seeks $5,000 per violation for each class member as well as injunctive relief to prevent Mint Mobile from recording calls without consent in the future.
In 2023, Mint Mobile appealed a ruling by the National Advertising Division that the company misled consumers with advertising that stated it offered plans for “now just $15/mo.”
