
Facing debt collection can be a demoralizing experience. However, debt collection laws exist to protect consumers when bill collectors go too far and engage in debt collection abuse.
According to a debt collection lawsuit filed in September, Midland Credit Management Inc. allegedly violated the Fair Debt Collection Practices Act on several counts, and the plaintiff is seeking an injunction to stop the debt collection abuse, as well as collection of damages for the unfair debt collection practices allegedly committed against her by MCM.
According to her Midland Credit Management lawsuit, plaintiff Chloe A. has been on the receiving end of several unfair debt collection practices that violate the FDCPA. Chloe claims that MCM called at least 15 times if not more since the calls began in March. Several aspects of the alleged debt collection phone calls suggest the use of an auto dialer or a similar device, a violation of FDCPA statutes.
According to the Midland Credit Management lawsuit, all calls from MCM were intended for another person that Chloe says she does not know.
Chloe alleges in her Midland Credit Management FDCPA lawsuit that she never gave the company permission to call her, let alone contact her via cellular phone. Her FDCPA lawsuit further claims that the company is engaging in debt collection abuse by harassing Chloe over someone else’s debt.
The Midland Credit Management FDCPA Lawsuit is Case No. 2767, in the U.S. District Court for the Middle District of Florida, Fort Meyers Division.
FDCPA Violations and Possible Legal Remedies
Under the Fair Debt Collection Practices Act, debt collection is regulated by the government, and consumers effectively have a “bill of rights” when facing debt collection. Some examples of how FDCPA laws work to curb certain unfair debt collection practices include preventing debt collectors from calling a person at work, limiting a creditor’s ability to constantly harass consumers with phone calls, and limiting the use of devices like auto dialers (or automated dialing systems).
According to the MCM lawsuit, Chloe seeks to recoup statutory damages from Midland Credit Management under the FDCPA and several related Florida laws. A statutory damage is a type of damage that is applied under the law, regardless of the cost of actual damages. In the case of a FDCPA violation, a person is entitled to $500 for every negligent violation of the FDCPA and $1,500 for every deliberate violation of the law. Chloe also seeks to recoup legal fees from MCM for the filing and subsequent court proceedings of this FDCPA lawsuits, as allowed by the FDCPA.
