A plaintiff couple from New York has filed a mesh hernia repair lawsuit, claiming that the husband’s need for explantation surgery was a result of the defective nature of the medical device.
Plaintiffs John M. and Virginia M. have filed this mesh hernia repair lawsuit against Atrium Medical, the makers of the C-QUR Mesh V-Patch.
John was implanted with the C-QUR Mesh V-Patch made by Atrium at Benedictine Hospital in Kingston, N.Y. on Feb. 24, 2014. Thereafter, according to his mesh hernia repair lawsuit, he suffered from severe and unexpected complications.
John claims he experienced a collection of fluid (the formation of a seroma), as well as the need for additional surgery to remove the C-QUR Mesh V-Patch and repair the problem. John’s mesh hernia repair lawsuit says that he may need to receive treatment in the future as any additional injuries are determined.
According to the short form mesh hernia repair lawsuit complaint, the plaintiffs are asking for “compensatory damages … for past, present, and future damages, including, but not limited to, pain and suffering for severe and permanent personal injuries, … permanent impairment, mental pain and suffering, loss of enjoyment of life, past and future health and medical care costs, and economic damages including past and future lost earnings and/or earning capacity.”
John has brought forth this mesh hernia repair lawsuit on multiple counts including negligence, design defect, manufacturing defect, failure to warn, defective product, fraudulent concealment, constructive fraud and negligent misrepresentation.
Additionally, counts of negligent infliction of emotional distress, violation of consumer protection laws, gross negligence, unjust enrichment and loss of consortium were filed in this hernia mesh repair claim.
This Mesh Hernia Repair Lawsuit joins MDL No. 2753 and is Case No. 1:18-cv-16 in the United States District Court for the District of New Hampshire.
What is Hernia Mesh?
Surgical mesh is a synthetic or non-synthetic medical device that helps in the repair of hernias. A hernia is a tear in the wall of the abdominal muscle or groin area that, if not repaired, can become quite serious.
