  • Mercedes-Benz asked a Georgia federal court to dismiss a class action lawsuit accusing the automaker of failing to disclose a wheel configuration defect allegedly present on some of its S580 sedans. 
  • Mercedes-Benz argued the class action lawsuit includes only conclusory allegations by a driver who claims to have suffered two driver-side front-tire blowouts during a road trip as a result of the alleged defect.  
  • The individual argues Mercedes-Benz manufactured certain model year 2021 and newer S580 sedans with defective 21-inch AMG v-multi-spoke wheels and tires allegedly prone to blowouts, punctures and deflation. 
  • Mercedes-Benz argues the complaint fails to explain the alleged defect and the claims rely only on the individual’s two punctured tires.

Mercedes-Benz wheel defect class action lawsuit overview: 

  • Who: David Chappell filed a class action lawsuit against Mercedes-Benz USA LLC and Mercedes-Benz Group AG. 
  • Why: Chappell claims Mercedes-Benz failed to disclose a wheel configuration defect present in its model year 2021 and newer S580 Sedan vehicles that are equipped with a 21-inch AMG V-multi-spoke wheel configuration.
  • Where: The Mercedes-Benz defect class action lawsuit was filed in Georgia federal court.

Mercedes-Benz failed to disclose a wheel defect present in model year 2021 and newer S580 Sedan vehicles equipped with 21-inch AMG V-multi-spoke wheels, a new class action lawsuit alleges. 

Plaintiff David Chappell’s class action lawsuit claims the Mercedes-Benz vehicles are equipped with wheels and tires that cause “sudden and repeated” tire blowouts, punctures and deflation, as well as sidewall bubbling and cracked rims.

“The 21” Wheel Configuration in use on the Class Vehicles is insufficient to withstand the weight of such vehicles, which results in the failure of its structural integrity, which inexorably leads to the tire and wheel degradation,” the Mercedes-Benz wheel defect class action claims. 

Chappell wants to represent a nationwide class and Nevada subclass of consumers who bought or leased a model year 2021 or newer S580 Sedan vehicle with the allegedly defective wheels.

Mercedes-Benz class action: Automaker knew of defect, concealed issue

Chappell argues Mercedes-Benz knew about the alleged wheel configuration defect from pre-production testing and design failure mode analysis — in addition to multiple other reasons — but chose to conceal and deny the issue to consumers. 

“Mercedes has actively concealed the existence of the defect, telling customers … that the wheels and/or tires are not defective and that the blowouts are caused by potholes or other driver error, without any such evidence to support external causes,” the Mercedes-Benz defect class action says. 

Chappell claims Mercedes-Benz is guilty of fraud by omission or fraudulent concealment, unjust enrichment and breach of express warranty, and violating Nevada’s Deceptive Trade Practices Act, a pair of Nevada statutes and the Magnuson-Moss Warranty Act

The plaintiff demands a jury trial and requests declaratory and injunctive relief, as well as an award of compensatory, exemplary and statutory damages for himself and all class members. 

Mercedes-Benz recently issued three recalls for more than 137,000 of its model year 2020-2024 vehicles over defect concerns including bad welds on an accelerator pedal, faulty fuses and a transmission shifting issue.

    I have a suspicion that Mercedes Benz in Seattle charges people when they exchange cars for repairs if some defect , scratch, glass etc but then doesn’t repair the item and just sells the car as is basically ripping off the new buyer and the old buyer . It’s genius because you have no way of knowing what the previous guy was charged unless we ask them. I just noticed they always charge me when I leave my car but when I get a new one a lot of items are not fixed .

    I WANT TO JOIN! I am have been having issues with my rims and tires for years. They knew about it and did not say anything. A 10k job and we believe they committed insurance fraud

    I own a 2021 Mercedes-Benz CLS 450 equipped with 20″ AMG wheels. Unfortunately, my experience has been far from ideal. Each year, I find myself needing to replace 3-4 tires and 2 wheels, all thanks to the Tire and Wheel package I thankfully purchased.

    I’ve owned several vehicles in the past, and I have never encountered issues like these. It’s disheartening to see this situation tarnish what I once believed to be the excellent reputation of Mercedes-Benz.

    Due to these ongoing problems, I am now considering selling my car before my wheel package expires, which feels incredibly unfair. How ridiculous is that?

    I would also like to express my interest in participating in a class action lawsuit regarding these issues.

    We have a 2022 Mercedes CLS with 19 inch rims. My husband had four blow outs in the past 11 months. we’ve had A Porsche Panamera BMW, and a jaguar before with the same size or even bigger rims never had a problem. I absolutely believe that there is a problem here and Mercedes knows it. I feel that it’s absolutely a disgrace that they not helping customers that no longer feel comfortable driving their vehicles. My husband is trying to get out of this car as soon as he can and I refuse to drive it. he’s also not allowed to have our children in it. It is a complete slap in the face after buying what one would think is a very reputable brand. We will never ever ever buy another Mercedes. I think there needs to be a class action lawsuit because there is so many victims like us.

    I have a 2021 Mercedes S 580 and had two blow outs of multiple tiers and my car was with the dealer for more than 10 days second time before they could order the tires and fix it. I have tried to file a lemon law suit but backed of because of the potential expenses involved. My wife would not drive the car either.

    I had 2 blow out. But my Mercedes-Benz is a ML320. And it is a older one. And I have had it less than a year. I am thinking about getting rid of it now.

    I own a 2021 S580 with 21 inch pirellis and AMG rims that I purchased less than a year ago with a certified warranty. I’ve had two wheel blowouts since then and now my wife is afraid to drive the car

    I believe I have a class action with Mercedes Benz – I got a 1 year warrantee PLUS extended warrantee but they want to charge $257 for EACH thing they check on. It’s a rip off.
