Consumers filed separate lawsuits against McDonald’s Corp. over claims they became sick with E. coli after purchasing and consuming food from the fast food restaurant chain.
The plaintiffs filed the class actions in the wake of federal health agencies announcing an investigation into an E. coli outbreak linked to food items served at McDonald’s that sickened consumers in a number of states.
The majority of individuals who became ill from the E. coli outbreak reported consuming McDonald’s Quarter Pounders, according to the McDonald’s lawsuits, which say the company responded by temporarily suspending the use of fresh slivered onions and quarter-pound beef patties in regions the outbreak affected.
The Centers for Disease Control and Prevention identified the ingredients as possible sources of the E. coli outbreak, according to the McDonald’s lawsuits.
The CDC, along with the Food and Drug Administration and U.S. Department of Agriculture’s Food Safety and Inspection Service, announced an investigation into the E. coli outbreak Oct. 22, the lawsuits say.
McDonald’s E. coli outbreak sickened consumers in 10 states, lawsuits say
A man from Colorado and a woman from Nebraska filed the complaints. In both cases, the plaintiffs argue they became ill with symptoms of E. coli days after consuming McDonald’s and sought medical attention in the emergency room.
Both plaintiffs claim they ultimately tested positive for E. coli and are recovering from the effects of the alleged food poisoning.
The E. coli outbreak sickened consumers in Oregon, Kansas, Montana, Missouri, Iowa, Wisconsin, Utah, Wyoming, Nebraska and Colorado, according to the McDonald’s lawsuits.
The lawsuits bring claims under strict products liability, negligence and negligence per se and breach of implied warranties.
The plaintiffs both demand a jury trial and request an award of past and future economic and non-economic damages.
A consumer filed a class action lawsuit against McDonald’s last year over claims the company misleads consumers into thinking its breakfast combos come with orange juice when, in reality, the restaurant adds an undisclosed surcharge for meals that include juice.
