Essure Birth ControlA massive Essure side effects lawsuit has recently been filed against Bayer Healthcare in Missouri state court by 95 women across the country who allege the permanent birth control device caused severe harm.

The 150-page massive Essure side effects lawsuit details both the general allegations made by the group of women as well as specific plaintiff allegations outlined by individuals.

Essure is classified as a Class III medical device intended to be used as permanent birth control without the need for surgery.

It was first approved by the FDA in November 2002 by a company called Conceptus, which was later acquired by Bayer in June 2013.

The Essure device itself consists of three components in the system-a pair of micro-insert coils, a disposable delivery system and eight disposable split introducer.

Each Essure system is designed for a single use.

In an outpatient visit, a physician inserts the micro coils into the patient’s fallopian tubes via the vagina and cervix with the use of the disposable delivery system.

Once the device is implanted, after about three months the tissue grows around the coils which causes a blockage of the fallopian tubes, creating a barrier that the sperm cannot pass in order to fertilize the egg, preventing pregnancy.

The massive Essure side effects lawsuit alleges that Bayer and former manufacturer Conceptus had faced early regulatory violations, knew of ongoing manufacturing problems, concealed thousands of reports of device migration and perforation from the FDA, concealed safety complaints and withheld safety information and misled the FDA about the rates of Essure breaking.

In February of this year, the FDA required a boxed warning to appear on each Essure warning label indicating the device poses the highest level of risk.

However, the plaintiffs in the current lawsuit allege that they were harmed in various ways before such a strict warning was issued.

The plaintiffs have alleged a number of personal injuries including pain, discomfort, heavy menstrual bleeding, abdominal bloating and pain, hair loss, chronic fatigue, autoimmune diseases, pain during intercourse, weight gain, excessive rashes, tubal pregnancies and more.

The women have brought forth a total of 14 counts against Bayer including multiple counts of negligence, strict liability for failure to warn, manufacturing defect, common-law fraud, constructive fraud, fraudulent concealment, breaches of express and implied warranties, violation of consumer protection laws, violation of state consumer protection laws and gross negligence/punitive damages.

The plaintiffs in the massive Essure side effects lawsuit are seeking compensatory damages for past, present and future damages incurred including pain and suffering, emotional distress and anguish, severe and permanent personal injuries, health and medical care costs and interest, economic and noneconomic damages, specific damages, punitive and exemplary damages, pre-and post-judgment interest, attorneys’ fees and costs and any additional relief deemed just and proper by the Court.

Not the Only Massive Essure Side Effects Lawsuit

At least two other massive Essure side effects lawsuit actions have been filed against Bayer with similar allegations.

One massive Essure side effect lawsuit was filed in federal court in August by 90 women who suffered a variety of adverse events following their use of the permanent birth control device.

Another massive Essure side effects lawsuit was filed in August of this year in Missouri state court by a group of 98 women who allege they suffered from Essure birth control complications as a result of using the medical device.

Additional lawsuits against Essure with a large number of plaintiffs may also be pending in the courts.
