Plaintiff Calvin G. has filed a lawsuit in Texas federal court alleging that his Pinnacle hip replacement caused severe adverse effects and complications.
Calvin files the Pinnacle hip replacement lawsuit against DePuy Orthopedics, Inc., and Johnson & Johnson.
Calvin is a resident of the state of Virginia. He says that on July 5, 2005, he underwent hip replacement surgery and became implanted with the DePuy Pinnacle metal-on-metal hip implant.
However, the Pinnacle hip replacement lawsuit maintains that since his surgery, he “suffered symptoms, including, but not limited to, pain, swelling, inflammation, infection, and damage to surrounding bone and tissue, and lack of mobility.”
The Pinnacle hip replacement lawsuit alleged that had Calvin known of these adverse side effects and complications, he would not have decided to be implanted with the DePuy Pinnacle metal-on-metal hip implant device.
The Pinnacle hip replacement lawsuit further asserts that in February 2017, he underwent revision surgery of the Pinnacle Metal-on-Metal Hip Implant to replace it.
Calvin alleges that due to the implantation of the hip device, he suffered and will continue to suffer significant harm. Such harm includes, according to the Pinnacle hip replacement lawsuit, “physical injury and bodily impairment, debilitating lack of mobility, conscious pain and suffering, and loss of earnings.”
The Pinnacle hip replacement lawsuit alleges that he will continue to suffer future harm.
Calvin files the following damages against the manufactures and defendants. These include the following: 1) Negligence, 2) Strict Liability (Manufacturing Defect), 3) Strict Products Liability (Design Defect), 4) Strict Products Liability (Inadequate Warning), 5) Strict Products Liability (Failure to Conform to Representations), 6) Strict Products Liability (Failure to Adequately Test), 7) Breach of Express Warranty, 8) Breach of Implied Warranty of Merchantability, 9) Fraudulent Concealment, 10) Intentional Misrepresentation, and 11) Negligent Misrepresentation.
He demands a trial by jury.
Pinnacle Hip Replacement Facts
There have been reports of over 93,000 ASR and ASR XL metal hip implants recalled due to patients suffering severe adverse effects and complications due to their implantation. Reports of these issues include patients developing complications such as metallosis and corrosion or fretting of their metal hip components.
When this metal-on-metal hip implant device was first released on the market, it was thought to be superior to their former plastic and ceramic models. Manufacturers, such as DePuy and Johnson & Johnson, had advertised them to be more longer lasting and more durable than their competitors.
The companies had also represented these implants to be able to handle harsher movements that patients may use them for such as running. Their use and implantation have become even more popular among younger patients who live a more active lifestyle.
However, not long after their release onto the market, patients implanted with the metal-on-metal device reported suffering metallosis and other device failures. Metallosis occurs when the metal-on-metal implant releases metal into the patient’s bloodstream. This can cause other adverse effects and complications.
