Overview: Hernia Mesh Pain
There are several serious and life-threatening side effects following hernia mesh surgeries. Among these complications include bowel perforation, adhesion, autoimmune reactions to the mesh, and mesh migration and rejection.
The purpose of a surgical hernia mesh is to repair damaged or weakened tissues that causes hernias. According to the U.S. Food and Drug Administration (FDA), a hernia occurs when a tissue, intestine, or organ inserts itself into a weakened spot of the surrounding connective or muscle tissue. Most hernias occur at the wall of the abdomen.
The most common types of hernias are femoral, inguinal, incisional, ventral, umbilical or hiatal. Although anything that increases pressure against the abdominal wall can cause a hernia, risk factors may include the lifting of heavy objects, obesity, persistent coughing or sneezing, and diarrhea or constipation.
In total, there have been more than 3,000 hernia mesh lawsuits filed in federal courts after patients reported serious adverse effects ranging from organ perforation and seroma. There has been at least one verdict amounting to a settlement amount of $184 million.
Pending lawsuits have been consolidated in a multidistrict litigation (MDL) in federal court. Currently, there have been at least 30 Atrium C-Qur mesh lawsuits pending in New Hampshire federal court since the new year. Accusations against hernia mesh manufacturers, including the manufacturer of the C-Qur Edge, Atrium Medical Corporation, include several counts of negligence. The accusations against the company include the following:
• Failing to warn the public of complications and adverse effects
• Manufacturing a defective product
• Conducting inadequate hernia mesh testing
• Intentionally and recklessly hiding important hernia mesh information
• Inaccurately representing the safety and effectiveness of hernia mesh
• Negligence for manufacturing, marketing and designing an unsafe hernia mesh product
