Made in USA class action lawsuits overview:

  • Who: Consumers have taken legal action against brands including Mielle Organics, Paul Mitchell, Goya Foods, PepsiCo, Unilever, the Pepsi Lipton Tea Partnership, McCormick & Co., and Reynolds Wrap.
  • Why: The class action lawsuits allege these companies used false or misleading “Made in USA” labeling.
  • Where: The cases were filed in United States federal courts.

Recent class action lawsuits have targeted popular consumer products, alleging that they use false “Made in USA” labeling.

The lawsuits come as President Donald Trump imposes tariffs amid what his administration describes as a push for more domestic manufacturing.

In addition to the new class action lawsuits, a New York federal judge also recently declined to throw out a class action lawsuit filed against Reynolds Wrap over similar “Made in USA” claims.

Mielle Organics falsely advertised hair care products as made in U.S., class action says

A consumer filed a class action lawsuit against Mielle Organics over claims the company falsely advertises its hair care products as being made in the United States with natural ingredients.

The class action lawsuit argues Mielle’s hair care products contain synthetic ingredients and foreign-sourced components like tea tree oil and coconut oil, despite their “Made in the USA” labeling.

“By failing to disclose the use of foreign ingredients and components, the Defendant has unfairly and deceptively misrepresented the Class Products as being of purely U.S. origin,” the Mielle Organics class action says.

The consumer wants to represent a California class of consumers who purchased Mielle Organics’ products labeled as “Made in the USA” or “natural” within the past four years.

Class action claims Paul Mitchell hair care products not actually ‘Made in the USA’

A pair of consumers filed a class action lawsuit against John Paul Mitchell Systems over claims the company’s hair care products are deceptively labeled as being “Made in the USA.”

The class action lawsuit argues Paul Mitchell’s hair products actually contain foreign ingredients and consumers are misled into purchasing them under the belief they were supporting American jobs and industries by doing so.

“This is a material factor in many purchasing decisions, as consumers believe they are buying superior goods while supporting American companies and jobs,” the Paul Mitchell class action says.

The two consumers want to represent an Illinois class and California class of consumers who have in the past four years bought Paul Mitchell products labeled “Made in the USA” that were made with or contained ingredients or components not grown or manufactured in the U.S. with or contained ingredients or components not grown or manufactured in the U.S.

Goya misrepresented some products as made in the U.S., class action alleges

A consumer filed a class action lawsuit against Goya Foods Inc. over claims the company misrepresented some of its products as being made in the United States.

The class action lawsuit argues the Goya food products in question actually contain foreign ingredients, despite being labeled as a “Product of USA.”

Class action claims Pure Leaf tea products falsely advertised as ‘Brewed in USA’

A consumer filed a class action lawsuit against PepsiCo, Unilever and Pepsi Lipton Tea Partnership over claims the companies falsely advertise Pure Leaf tea products as being “Brewed in USA.”

The class action lawsuit argues Pure Leaf tea products contain foreign-sourced, grown or manufactured ingredients — primarily tea leaves — despite labeling that leads consumers to believe the products are made entirely in the United States.

The consumer wants to represent a California class of consumers who purchased Pure Leaf products labeled “Brewed in USA” within the last four years.

McCormick falsely advertised mustard products as made in U.S., class action claims

A consumer filed a class action lawsuit against McCormick & Co. Inc. over claims the company falsely advertises its mustard products as made in the United States.

The class action lawsuit argues McCormick’s mustard products are labeled as “Crafted and Bottled in Springfield, MO, USA,” despite containing foreign-sourced ingredients like mustard seeds and turmeric.

“Plaintiff and Class members purchased the Class Products, believing they were entirely grown and made in the United States without foreign-sourced, grown or made ingredients and/or components,” the McCormick class action claims.

The consumer wants to represent a California class of consumers who purchased McCormick mustard products labeled as “Crafted and Bottled in Springfield, MO, USA” within the past four years.

Judge won’t toss claims Reynolds Wrap aluminum foil not really made in U.S.

A New York federal judge recently declined to throw out a class action lawsuit filed against Reynolds Wrap over claims the company falsely advertises that its aluminum foil products are made in the United States.

The class action lawsuit argues a vital component of Reynolds Wrap’s aluminum foil products is sourced from outside the United States, despite the products’ representation as “FOIL MADE IN U.S.A.”

The judge, in declining to dismiss the complaint, determined the products’ labeling correlated to premium pricing and therefore constituted “economic harm.”
