Another plaintiff has filed a Lipitor lawsuit as part of the national Lipitor multidistrict litigation.
Like many of the previous Lipitor lawsuits added to the MDL, this Lipitor lawsuit claims Pfizer Inc.’s popular high cholesterol medication allegedly causes type-2 diabetes.
Plaintiff Willie D., a 75-year-old resident of North Carolina, filed the Lipitor lawsuit in September. Willie alleges that her use of the cholesterol-lowering drug caused her to develop type-2 diabetes.
Instead of providing Willie with the advertised health benefits, her Lipitor prescription allegedly negatively impacted her health. Willie claims to have suffered from significant physical, emotional, mental, and financial stresses and challenges as a result of Lipitor.
According to her Lipitor type-2 diabetes lawsuit, Willie was first prescribed Lipitor in June 2009. She continued to take the cholesterol treatment until August 2013, about a year after she was diagnosed with type-2 diabetes.
Willie alleges that because of Pfizer’s actions or inactions, she has suffered serious bodily injury, and her injuries have caused economic losses, pain and suffering, emotional distress and loss of enjoyment of life.
The Lipitor lawsuit brings claims of negligence, negligent misrepresentation, negligent design, design defect, failure to warn, breach of express and implied warranties, fraud and misrepresentation, constructive fraud, unjust enrichment, and punitive damages.
The Lipitor Type-2 Diabetes Lawsuit is Case No. 2:15-cv-03640-RMG and is part of the Lipitor MDL known as In re: Lipitor (Atorvastatin Calcium) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2:14-mn-02502-RMG, in the U.S. District Court for the District of South Carolina, Charleston Division.
Lipitor Type-2 Diabetes
According to recent medical studies, use of Lipitor has been linked to an increased risk of type-2 diabetes, especially in Lipitor users who are women or around middle age. These findings are particularly troubling, as Lipitor is one of the most popular prescriptions in the U.S. and around the world.
Millions of women have been prescribed and subsequently taken Lipitor for years at a time to help with heart attack and stroke prevention, without knowing that they were exposing themselves to other health complications such as type-2 diabetes.
Since February 2012, the FDA has required Pfizer to include a diabetes risk warning on Lipitor’s warning label. This requirement was brought on by the results of a January 2012 Lipitor study published in the Archives of Internal Medicine, which found that female users of Lipitor and other statin drugs who were between ages 50 and 79 had a 48 percent increase of developing type-2 diabetes.
Since then, several other Lipitor diabetes studies have been published with similar results.
If you are a woman who took Lipitor and were later diagnosed with diabetes, you may have grounds to file a Lipitor lawsuit and receive compensation.
