A new class action lawsuit alleges Liberty Mutual Insurance Company made illegal robocalls to consumers without their consent.

Plaintiff Yevonne Powers claims Liberty Mutual made the robocalls as part of an aggressive telemarketing campaign aimed at growing its business.

Powers argues Liberty Mutual made the robocalls and sent text messages to consumers without their consent in violation of the federal Telephone Consumer Protection Act (TCPA).

“Liberty Mutual is engaged in a prolific prerecorded-voice call campaign to American consumers, robocalling many millions of consumers’ residential and cellular telephones, without proper consent, over the course of several years,” the Liberty Mutual class action lawsuit says.

Powers wants to represent a nationwide class of consumers who received a robocall from Liberty Mutual or a third party on its behalf within the past four years.

Liberty Mutual failed to scrub call lists, class action alleges

Powers argues Liberty Mutual failed to scrub its call lists to ensure it was not making telemarketing calls to consumers who had registered their phone numbers on the National Do Not Call Registry.

“Liberty Mutual’s calls were annoying and a nuisance and wasted the time of Plaintiff and the class,” the Liberty Mutual class action lawsuit argues.

Powers claims Liberty Mutual is guilty of making robocalls and phone calls to numbers on the National Do Not Call Registry in violation of the TCPA and Virginia Telephone Privacy Protection Act.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages for herself and all class members.

In a similar case, American Income Life Insurance Co. recently agreed to a $14 million settlement to resolve a class action lawsuit claiming it violated the TCPA by making unsolicited telemarketing calls to consumers.
