Essure is a permanent, non-surgical form of birth control manufactured by Bayer HealthCare. Upon its release, it was considered a breakthrough in non-surgical, permanent birth control. It was advertised as a safer alternative to tubal ligation, or “tube tying,” and was originally approved by the FDA in 2002 on a fast track review system. Despite a promising start, Essure may come with some serious complications.

Many women who have used Essure claim that they experienced serious complications as a result of the birth control. Allegedly, they were not alerted about the possibility of these side effects. Reported side-effects of Essure include:

  • rashes
  • bloating
  • excessive bleeding
  • allergic reactions
  • organ perforation
  • miscarriage
  • pelvic pain
  • ectopic pregnancy

The Essure birth control system was initially developed by Conceptus, then purchased by Bayer HealthCare. The Essure birth control system consists of two polyester and metal coils that are placed inside each fallopian tube via insertion through the vagina and uterus. When the system functions properly, tissues develop around the coils over a few months. This tissue then blocks conception. To verify the success of the system’s implantation, patients who receive the implantation procedure must be evaluated by a doctor to confirm that they are no longer able to become pregnant.

Numerous women have brought forward complaints about the severity of side-effects about which they claim they were not warned. Many women have questioned if the FDA sufficiently investigated potential side effects of Essure before the birth control system was released onto the market.

Led by consumer advocate Erin Brockovich, thousands of women are campaigning to have Essure recalled from the market, claiming that the procedure should never have been approved by the FDA. As part of this effort, they are lobbying the FDA to urge them to remove the system from the market.

If you or a loved one experienced side-effects as a result of using Essure and you feel like you did not receive adequate information about the procedure’s side effects, you may have a legal claim. Several lawsuits have already been filed against Bayer challenging the company’s decision to sell Essure as a viable form of permanent birth control despite its notable side effects.

In the Essure side effects lawsuits, patients challenge the premarket approval, or fast track approval given to Essure by the FDA. Allegedly, the fast track approval shields Bayer from product liability, which otherwise would come into play regarding the numerous reports from patients experiencing side effects allegedly as a result of the Essure birth control system.

The current Essure birth control system class action lawsuit goes on to claim that the system’s FDA approval was based on results gained from questionable studies, and that the system should have been subjected to further study before being released to the market.

Women who experienced adverse side effects after having the Essure birth control system implanted may be able to receive compensation for physical and emotional injury by filing a valid legal claim.

In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
