A new lawsuit has been filed after a plaintiff had to go through DePuy ASR revision hip surgery. Many different patients have filed lawsuits against the manufacturer of the hip replacement implant which was designed to increase mobility. These plaintiffs report they began to experience painful side effects shortly after their initial implant surgery.
Many of those cases were referred for DePuy ASR revision hip surgery. The plaintiff in this hip implant lawsuit, Robert C., says that he was critically injured by getting a hip implant that he thought would help him. The plaintiff claims he suffered injury and economic loss as a result of getting a DePuy ASR hip implant.
Robert says he received the right hip implant in August 2007 in Sacramento, Calif. In July of 2017, however, there were numerous problems connected to his ASR hip implant, including the need for DePuy ASR revision hip surgery. His right hip has caused him physical pain and suffering since the original surgery.
He also alleges that he has suffered the need for additional surgery, increased medical expenses and medical care, lost future earnings and earning potential, suffering and mental pain.
The DePuy ASR revision hip surgery occurred on July 31, 2017 in Sacramento. The explantation and implantation of his initial device allegedly caused him severe side effects and injuries, and he alleges that the defendants knew about the possible dangers.
The plaintiff said that he could not have known that he was suffering from excessive levels of cobalt and chromium in his blood until after the date he had his blood drawn.
The plaintiff says he is entitled to recover compensatory damages for economic loss as well as punitive damages. He makes multiple allegations in the DePuy ASR revision hip surgery lawsuit, including breach of implied warranties, strict products liability, manufacturing defect, failure to warn, negligent misrepresentation, fraudulent concealment, fraud and deceit, negligent infliction of emotional distress, punitive damages, loss of consortium and more.
Manufacturers may be held responsible after it is discovered that they either knew or could have known about the possibility of serious side effects for patients, but did not offer the patients an adequate warning.
Many of those patients have turned to the option to receive DePuy ASR revision hip surgery, which comes with its own unique set of risks. Some of those individuals have chosen to file lawsuits in order to protect their rights to move forward.
Revision surgery comes with more more pain for the patient after the procedure is complete. Additionally, there is often more downtime for the patient and the possibility of an infection after the revision surgery. Patients who have taken legal action say they never should have had to go through the revision surgery to begin with but had no choice since the original product was defective.
