CertainTeed has been hit with a lawsuit in which a widow alleges that her late husband’s asbestos-related lung disease was caused by exposure to asbestos in the company’s products.
According to plaintiff Joann Z., her husband Joseph Z. inhaled or was exposed to asbestos fibers from CertainTeed’s products at numerous points in his life, which led him to develop lung cancer and later resulted in his death.
The asbestos lawsuit claims that his death was wrongfully caused by exposure to CertainTeed’s asbestos products, and could have been prevented had CertainTeed used alternative materials to produce their products.
The asbestos-related lung disease lawsuit claims that CertainTeed continued to use asbestos even though non-toxic substitute materials were available to the company. According to Joann Z., the company failed to test their products to determine if they were safe for consumers to be in the proximity of and to use.
The CertainTeed asbestos lung disease lawsuit states that Joseph Z. was diagnosed with lung cancer around Dec. 21, 2016. He passed away on Aug. 19, 2017. Joann Z. seeks damages of more than $50,000.
Suing over Asbestos-Related Lung Disease
Numerous lawsuits like Joann’s are cracking down on manufacturers of products containing asbestos, investigating asbestos-related lung disease.
Many individuals who have been diagnosed with lung cancer are investigating a link between their cancer and their exposure to asbestos, a naturally occurring, carcinogenic mineral that was commonly used in construction materials between the late 19th century and the 1990s.
As a result, companies who historically manufactured products containing asbestos have come under fire for their involvement in harming individuals through their use and sale of asbestos in various materials.
As early as the 1920s, concerns were raised that exposure to asbestos could cause asbestos-related lung disease. It is now known that prolonged inhalation of asbestos fibers can cause an individual to develop a number of conditions, including lung cancer. These conditions are serious, and can result in serious injury or death.
In the 1980s, restrictions were passed in the United States and in countries around the world that banned or severely restricted the use of asbestos in building materials. Nonetheless, many companies continued to use the harmful mineral in their products, releasing the products to the general public. These products appear commonly in houses, businesses, and many other buildings.
According to numerous lawsuits, many companies continued to produce and sell products that contained asbestos, though they knew of the risk of asbestos-related lung disease those products posed.
Individuals who have experienced prolonged exposure to asbestos and later developed lung issues may have asbestos-related lung disease. Individuals who were adversely impacted by exposure to asbestos, or who have a loved one who was exposed, may find that a class action lawsuit is a way that can receive financial compensation for their physical, emotional, and financial injuries.
