A new lawsuit joins several thousand others in the multidistrict litigation against Daiichi Sankyo and Forest Laboratories, manufacturers of Benicar, a popular drug used to treat high blood pressure.
Plaintiff Sylvestor H. is a resident of Texas. The 59-year-old alleges that gastrointestinal pain from Benicar caused him personal injury. He began taking the drug in July 2014, and took both Benicar and Benicar HCT on different occasions.
As a result of taking Benicar, known generically as olmesartan, Sylvestor suffered from the following: “severe personal injuries in the form of gastrointestinal pain, distress, and other symptoms and sequelae, necessitating medical and other forms of treatment; medical and economic costs and injuries; and imposing severe limitations on Plaintiff’s activities of daily living and ability to enjoy life.”
The gastrointestinal pain from Benicar and related pains and subsequent injuries led Sylvestor to file the lawsuit against the manufacturers of Benicar.
Sylvestor has brought forth a number of counts against the manufacturers of Benicar including products liability for design defect and failure to warn, gross negligence, negligence per se, negligence, negligent misrepresentation, negligent design, fraudulent concealment, breaches of express and implied warranties, unjust enrichment and violation of state consumer protection laws of Texas.
In terms of relief for the gastrointestinal pain from Benicar and related pain and injuries, Sylvestor is seeking compensatory damages, punitive damages, interest, costs of suit and any additional relief as deemed appropriate by the Court.
Gastrointestinal Pain from Benicar Side Effects
The most commonly reported side effects from the popular blood pressure medication include gastrointestinal pain from Benicar. Many patients visit their doctors with complaints of this gastrointestinal pain and related symptoms, and doctors suspect celiac disease as the culprit.
However, when patients taking olmesartan test for celiac disease, a condition that causes an individual to have severe reactions to gluten, a protein found in wheat, barley and rye, most times their result is negative.
Conditions related to celiac disease are often present, and doctors diagnose patients with sprue-like enteropathy and villous atrophy. This affects the person’s body in a very similar way to those suffering from celiac disease – the gastrointestinal system functions poorly, and malnutrition can result.
Often accompanying the gastrointestinal pain of Benicar is severe diarrhea. The chronic diarrhea associated with Benicar can be so severe that sometimes patients must be hospitalized as a result.
Patients are not able to absorb nutrients from food and may also become dehydrated as a result of the serious diarrhea. Electrolyte imbalance affecting heart rhythm can also occur.
