La Valencia Hotel Class Action Settlement

If you’ve recently dined at one of the restaurants or bars at La Valencia Hotel in La Jolla, California, you may be able to claim a $40 voucher from a class action lawsuit settlement. The settlement covers anyone who was a customer at one of La Valencia’s dining facilities between November 20, 2008 and July 22, 2010, and was requested or required to provide a telephone number or “Personal Identification Information” during a credit card transaction.

According to the class action lawsuit, La Valencia Hotel used a credit card form in its restaurants and bars during the class period that contained a preprinted space specifically designated for filling in the telephone number and/or PIN of its credit card customers. Asking or requiring customers to provide this personal information during a credit card transaction is in direct violation of California law.

If you were asked to submit your telephone number or PIN in connection to a credit card purchase at a La Valencia Hotel restaurant or dining facility, either through a preprinted form or otherwise, you’re considered a class member. All eligible class members who submit a timely claim form can receive a $40 voucher that can be used toward the purchase of food and beverages at any of the restaurants or dining facilities at La Valencia Hotel. The vouchers are only valid for six months after they’re first issued, so claim your voucher right away. Only one voucher may be claimed per customer. Claim forms must be submitted within 60 days after October 7, 2010, and must include a copy of your receipt or the approximate date that you conducted a credit card transaction at a La Valencia Hotel restaurant and the type of credit card you used. La Valencia Hotel may conduct an investigation of all submitted claims for fraud, so don’t submit a claim unless you’re eligible.

If you wish to object or exclude yourself from this class action lawsuit settlement, you must submit your request by October 7, 2010. The Final Settlement Hearing will be held October 22, 2010 to determine whether the class action lawsuit settlement should be given final approved.
