Kraft MiO Flavored Water Class Action Lawsuit Overview:

The Kraft Heinz Company falsely advertises that its MiO brand flavored water enhancers contain only natural flavors, a new class action lawsuit alleges.
Plaintiffs Lisa Boss, Linda Gunnett and Peggy Tatum claim Kraft misleads consumers by failing to disclose that MiO actually contains “undisclosed artificial flavoring.”
Boss, Gunnett and Tatum want to represent a nationwide class and California subclass of consumers who purchased MiO on or after Jan. 1, 2014.
Boss, Gunnett and Tatum claim at least 18 of the MiO flavored water enhancers contain undisclosed artificial flavoring, namely dl-malic acid, a synthetic petrochemical.
“The ‘malic acid’ that Defendants put in the Products is not a natural flavoring but is instead a synthetic flavoring chemical manufactured in a petrochemical factory from petroleum feedstocks,” states the class action lawsuit.
Plaintiffs Claim Kraft is Guilty of Fraud By Omission And Negligent Misrepresentation
Boss, Gunnett and Tatum argue Kraft wilfully conceals that its MiO product contains artificial flavoring in order to “give consumers the false impression that they are buying a premium all natural product instead of a product that is artificially flavored.”
Further, Boss, Gunnett and Tatum claim Kraft is violating federal and state law by “misbranding” the product as made without any artificial flavors.
Boss, Gunnett and Tatum claim Kraft is, among other things, guilty of fraud by omission and negligent misrepresentation and in violation of Illinois Consumer Fraud and Deceptive Business Practices Act, California’s Consumer Legal Remedies Act and California’s Unfair Competition Law.
Plaintiffs are demanding a jury trial and seeking restitution along with actual, statutory and punitive damages for themselves and all class members.
A separate class action lawsuit was filed against Kraft earlier this year by employees claiming the company allowed workplace harassment to occur against Black workers.
